A new lawsuit filed in the Circuit Court for the Sixth Judicial Circuit in and for Pasco County, Florida Civil Division alleges that the makers and distributors of the Maxi Matic pressure cooker, Guangdong Tredy Electric Co. LTD and Pick Five Imports, doing business as Maxi-Matic USA Inc., have released a defective and unreasonably dangerous product to consumers as the Elite Platinum 8-quart Digital Maxi Matic Pressure Cooker.
The plaintiff in this lawsuit, Anne H., is a resident of New Port Richey, Fla., located in Pasco County. The personal injury which she sustained and which is the basis of this complaint occurred in this vicinity as well.
While both Guangdong Tredy Electric Co. LTD and Pick Five Imports are foreign-for-profit companies, both operate under the laws of the state of Florida by having authorized marketing and selling facilities located in the state.
Anne says she suffered severe pain from first and second-degree burns because of using the Maxi Matic pressure cooker which she had owned for three years and used without incident a handful of times prior to being injured.
The burns occurring on July 14, 2012, happened because of projectile food and scalding hot water exploding out of the Maxi Matic pressure cooker lid which opened unexpectedly.
According to the narrative of the lawsuit, the plaintiff operated the Maxi Matic pressure cooker on the day of injury compliant with the manufacturer’s instructions.
The instructions referred to a water fill line on the appliance above which the operator should not fill. Anne filled the appliance to that line precisely and then set a timer for 45 minutes to make sure it did not operate beyond the specified period. She then moved the setting to “airproof” per the manual and pressed the button marked “start”.
Anne says she had burns from this incident which required emergency transport to a regional hospital and then to the closest burn unit. The burns which were located on her hands, stomach, and right thigh required excising and full skin graft from a donor site on her unaffected left thigh.
Her hospitalization lasted ten days, but required follow-up home care to keep her wounds clean and bandages changed.
According to the Maxi Matic pressure cooker complaint, Anne was permanently scarred from this accident and believes the incident occurred because of a defective safety interlock on the device. She is bringing the following counts against the defendants:
Count One –Strict Liability, Guangdong Tredy Electric Co. LTD; Count Two –Strict Liability, Pick Five Imports; Count Three –Breach of Express Warranty, Guangdong Tredy Electric Co. LTD; Count Four –Breach of Express Warranty, Pick Five Imports; and Count Five –Negligence, Guangdong Tredy Electric Co. LTD; Count Six –Negligence, Pick Five Imports; Count Seven –Breach of Implied Warranty of Merchantability, Guangdong Tredy Electric Co. LTD; Count Eight –Breach of Implied Warranty of Merchantability, Pick Five Imports.
Anne is asking for a trial by jury with judgment against named defendants. She hopes for an award more than jurisdiction limitations of $15,000 for her personal injury along with interest and associated costs. This complaint was filed on Aug. 18, 2016.
