If you have made an online purchase from Stearns and Foster or another Tempur Sealy company, you may have been the victim of a serious data breach.
A number of Tempur Sealy websites may have been affected by a major Tempur Sealy data breach, exposing the personal information of customers. Information that may have been exposed could include your credit or debit card number and expiration date.
You may have been a victim of the Tempur Sealy data breach if you made an online purchase at one of the websites for these Tempur Sealy brand products sometime before October 2016: Stearns and Foster (StearnsandFoster.com), Tempur-Pedic (TempurPedic.com), or Sealy (Sealy.com).
The Tempur Sealy Data Breach
Tempur Sealy used the company Aptos to host and maintain its websites and online payment system.
In February 2016, Aptos’ platform was hacked and malware installed by an unauthorized person, which was meant to capture the payment information that had been provided to Aptos through dozens of the retailers it worked with, including Tempur Sealy.
Aptos customers were notified of the Tempur Sealy data breach in February 2017, but it occurred an entire year previously, in February 2016. Aptos first became aware that the data breach had occurred in November 2016, reported the situation to law enforcement agencies as the U.S. Department of Justice in December 2016, and notified Tempur Sealy and its other clients in February 2017.
In turn, Tempur Sealy waited an extra two months, until April 4, 2017, to notify its own customers that their data may have been compromised in the data breach. Those who may have been affected made online purchases from Stearns and Foster or other Tempur Sealy websites before October 2016. Information that may have been exposed includes:
- Name
- Address
- Email address
- Telephone number
- Credit/debit card number
- Card expiration date
While customers are now aware that the 2016 breach occurred, neither Tempur Sealy nor Aptos has revealed how many consumers’ personal information was compromised, or even the exact time frame of the records that were stolen.
Tempur Sealy Data Breach Class Action Lawsuit
Consumers have filed a class action lawsuit against Tempur Sealy, along with its former website host Aptos, alleging that the companies failed to protect the personal information of their customers. The lawsuit was filed in June 2017, and also accuses both Aptos and Tempur Sealy of failing to disclose the extent of the data breach and notify consumers.
“Had Defendants’ provided timely and accurate notice, Plaintiff and Class Members could have avoided or mitigated the harm caused by the data breach,” the class action lawsuit states.
