A woman from Pennsylvania recently filed a Lyft accident lawsuit against several insurance companies alleging they failed to compensate her for the injuries she suffered in their policyholder’s vehicle.
The Lyft accident lawsuit states that even though the driver of the vehicle the plaintiff was in had the exact insurance policies necessary to cover her injuries, they still refused.
Plaintiff Renee W. names Geico Insurance Company, Steadfast Insurance Company, and York Risk Services Group Inc. as defendants in her Lyft accident lawsuit.
Renee alleges that her Lyft driver had his car insured for potential injuries for passengers in case of a motor collision. Further, according to the Lyft accident lawsuit, Pennsylvania has a specific state law that allows uninsured motorist coverage, in which the driver’s insurance company would pay for all injuries suffered by “lawful citizens in the case of a motor vehicle accident.”
Overview of Lyft Accident Lawsuit
Renee says she suffered serious injuries during a vehicle collision on Oct. 25, 2016. According to the Lyft accident lawsuit, the incident occurred at or near the intersection of Red Lion Road and Jamison Avenue, in Philadelphia. Renee was at the time a passenger in a Lyft vehicle.
Renee says that during the accident she felt a sudden impact from behind, by an unknown vehicle that struck the Lyft driver’s bumper. The other driver reportedly sped off and left the scene of the accident, leaving Renee and the Lyft driver to contend with the aftermath.
According to the Lyft accident lawsuit, Renee suffered serious injuries to her neck and back, along with severe shock to her nervous system. Renee says she will most likely need medical treatment for quite some time, and has already incurred massive medical expenses.
Soon after the accident, Renee filed a claim for injuries with Geico and the other insurance companies under the uninsured motorist clause. The Lyft accident lawsuit states that the driver had this coverage and that the insurance companies are therefore obligated to pay for Renee’s medical expenses.
However, the insurance companies have allegedly failed to offer her a settlement or cover any of her damages.
Even though the other driver was at fault for the incident, they and their vehicle were not identified at the scene of the accident. If the other driver had not fled the scene, alleges the lawsuit, they most likely would be responsible for the physical injuries Renee had suffered along with the property damage to the Lyft driver’s vehicle. However, the compensation costs have fallen on Geico, Steadfast, and York Risk Services, says the lawsuit, and the companies should pay the damages under the terms of the uninsured motorist clause.
At this point in time, Renee says she has exhausted all administrative options and was forced to file this Lyft accident lawsuit.
