Another type-2 diabetes lawsuit has been filed against Pfizer Inc., alleging Lipitor, their popular cholesterol-managing medication, caused a New York woman to develop diabetes.

Plaintiff Aimee S., 67, filed this Lipitor lawsuit at the end of April of this year, claiming personal injury against Pfizer. According to her Lipitor lawsuit, Aimee began taking the drug in February 2002 to help manage her cholesterol and promote heart health. She claims she continued to take Lipitor as instructed by her doctor until she discontinued her prescription in 2012. During this decade of Lipitor use, Aimee was diagnosed with type-2 diabetes in April 2006; she now alleges that her medical condition was caused by her use of Lipitor.

According to the Lipitor lawsuit, “As a direct, proximate, and foreseeable result of Defendants actions or inactions, Plaintiff suffered grievous bodily injury and consequently economic and other losses, including but not limited to pain and suffering, emotional distress, and loss of enjoyment of life,” Aimee claims.

The plaintiff brings forth several allegations against Pfizer in this Lipitor type-2 diabetes lawsuit, including negligence, negligent misrepresentation, negligent design, products liability design defect and failure to warn, breach of express warranty, breach of implied warranties, fraud and misrepresentation, constructive fraud, unjust enrichment, punitive damages, and finally counts of violations of the New York Consumer Protection from Deceptive Acts and Practices Act.

The Lipitor Lawsuit is Case No. 2:15-cv-01811-RMG, in the U.S. District Court for the District of South Carolina, Charleston Division.

It is part of the Lipitor MDL known as In re: Lipitor (Atorvastatin Calcium) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2:14-mn-02502-RMG, in the same U.S. District Court.

Type-2 Diabetes and Lipitor Users

According to reports, over 4,000 women have reported they developed Lipitor type-2 diabetes after taking Pfizer’s Lipitor cholesterol treatment. As a result of this unfortunate Lipitor side effect, many of these women have filed Lipitor lawsuits. The majority of these type-2 diabetes lawsuits have been consolidated in the Lipitor MDL in South Carolina federal court.

The FDA issued a public health notice in August 2011, which required Pfizer to include new type-2 diabetes risk information in their Lipitor marketing and labeling, which includes warnings for other Lipitor side effects. A year later, the agency also followed this health notice with a general mandate to all statin drug manufacturers besides Pfizer to include a type-2 diabetes warning.

Pfizer finally complied with the FDA mandate in In February 2012, and updated Lipitor’s drug and product labels to feature a type-2 diabetes risk warning. While this labeling action by the pharmaceutical company benefits current and future Lipitor consumers, it does not reverse the Lipitor side effects many women consumers have suffered prior to 2012. As a result, many of these consumers have filed Lipitor lawsuits, seeking justice for their personal injuries related to their development of type-2 diabetes.
