Young happy couple shopping for new homeA class action lawsuit filed against Lennar Homes, a company that builds and sells residential units, claims that the company’s model homes mislead consumers.

Plaintiff Mohamed Elhendi claims that he was misled by Lennar Homes, who advertised model homes that were significantly different from the units actually for sale.

Elhendi alleges that Lennar Homes uses model homes to advertise different units actually for sale, claiming that the model homes are representative of the for-sale units. Allegedly, Elhendi decided to purchase multiple residential units based on the belief that they would be almost identical to the model home units.

The Lennar Homes class action lawsuit claims that the model homes advertise a certain layout of the bathroom and shower entrance. After the plaintiff purchased the residential units, he allegedly discovered that the homes he bought contained a radically different bathroom layout and shower entrance.

According to the Lennar Homes class action lawsuit, the bathroom in the model home was ADA compliant but the bathroom and shower in the purchased units were not ADA compliant, and Elhendi would have to spend thousands of dollars to make the spaces compliant.

Elhendi alleges that this practice of advertising a home with one set of layouts and features and selling a home with different features is a scheme that Lennar Homes uses to mislead many potential homeowners.

The Lennar model homes class action lawsuit claims that the goal of the scheme is to incentivize consumers to purchase residential units for a higher price than they are worth, or to purchase residential units that they otherwise would not purchase.

Specifically, Elhendi states that had he known that the residential units he bought had the characteristics that they actually had, as opposed to the ones advertised by the model homes, he would not have purchased the unit. Thus, he claims that Lennar Homes profited from intentionally falsely advertising its residential units.

Allegedly, Lennar Homes specifically advertises that the model homes are “substantially similar” to the residential units for sale. The Lennar class action lawsuit states that photos of the model homes are used to show the characteristics of the residential homes, and are provided to prospective buyers specifically for this purpose.

Elhendi believes that thousands of consumers were misled in similar ways, and proposes a Class of all consumers who were tricked by the advertising of the model homes into buying units that were not “substantially similar” to the model homes.

He seeks damages for himself and on behalf of other similarly affected California residents, citing financial injury done by Lennar Homes’ practice. He states that he lost “money [and] property, time, and attention” as a result of Lennar Homes’ practice.

Elhendi argues that unless the court forces Lennar Homes to cease their practice of falsely adverting their residential units, the company will continue to do so, and will thus continue to injure consumers. He states that Lennar Homes’ practice violates the California False Advertising Act, and constitutes unfair, unlawful, and fraudulent business practices.

The plaintiff is represented by Todd M. Friedman of the Law Offices of Todd M. Friedman PC.

    I’m in process in buying a house from Lennar homes. I need to know if I should do this. I already gave them $22000 that they will not return. I’m closing on January 30 2019 please can somebody with legal advise tell me what to do. I will really hate to loose this money I’m 63 years old and retired.

      I have no legal experience. But we were threatened in writing that our 10,000 closing deposit would not be returned if we did not meet a closing date suddenly dictated by Lennar. They had us reviewing 100+ pages of closing documents that were delivered for signatures by their notary on a work night after 9 PM on the required date of signing. We had never previously seen these documents and had little choice as to signing or forfeiture of our 10 grand. Then when we moved into the home, it was not even correctly built and took Lennar months to complete the necessary fixes. We suffered over 110,000 dollars of damages, health risks, and discomforts as a result of how everything was handled and are regretting having purchased from this company.

        WE also Had a similar experience with our Lennar build in Dayton, NV poor craftsmanship and rush to close with their lender, or lose our deposits. Would love to find a class action on this.

    We have just moved into our lennar home and though I love my home I am constantly saying this is mor done the model home had why do we not have it right now our issues are toilets simple issue. We have the exact same home as the model giallo gen ii with home automation well let me tell you people you need to ask on everything included because our sales person told us that our home automation was thrown in out of the goodness of her heart no it was in the model home and she misrepresented that it was included and so she had to get it thrown in. But our toilets are not the water sense push button toilets we had the side flush didn’t from the model our livingroom does not have the dimmer different from the model. I have argued and managed to get a lot of things corrected along with our realtor but Lennar everything included is a joke.

    I’m in Florida. Riverview. Lennar misleads and slops through the construction process. I used a realtor and am disappointed in her telling me Lennar was the best builder in the state. The things I wanted in a home I was told I could not have. Further, once I got down here realized she never presented all the new construction options just the ones that she would get a larger 5 vs 2-3 % commission from Lennar. I have reported her to her employer and plan to report both to the state licensing bureaus. Further I contacted my district representative regarding the failure to have I inspected by the county. They use their own inspectors. The home inspection I plan to have done tomorrow will tell me what is not in compliance. I have also found mold in a closet and can see daylight through my door edges.

    Lennar, realtors who recommend them, and cities and counties who allow them to build these poor quality houses slapping out in 60-90 days should be ashamed of themselves.

      My name is Leslie Ward I live in Waldorf Maryland we brought our home from lennar in December 19 2014. We’ve had several warrantee issues go out of warrantee waiting for Lala Eleanor to make repairs. Customer care representative only made our situation worse by not using certified contractors. As of today’s date I’m still waiting on management team in Waldorf Maryland to respond to an incident where one of their customer care representative stole my money and he was fired. When I contacted warrantee customer care they told me it was nothing they could do about him stealing my money. Lennar needs to be made accountable for these homes that are built with substandard materials built on lots that are part of swamplands. I’ve gone to news media to bring their attention to the public. I am currently looking for legal guidance to Help me in getting these matters resolved I am a senior citizen on a fixed income and I don’t have much time to spend back-and-forth with Lannar

      Do your own homework and do not blame Realtors for your laziness. Buyer beware. That means do your homework. Ask to view different builders. That was you that agreed to purchase the Lennar home.

      I have the same problem. My wife and I just bought a new construction Ladore Trevi model. We were shown the model house and decided that this is what we want when we went to see the home we be living and it was just the frame was up. We were told that everything is the same in the model and took our welders word for it sign and put a $60,000 deposit. When we went to look at our house, they redesigned the units. The master bathroom has a smaller shower, only one electrical outlet by the sink and master bedroom closet instead of two.. The colors on the exterior door, shutters and garage are awful and they will not let us change them. To top it off the model home has the exterior tour with a glass panels. The newer ones are a solid door so we have to now hire somebody if we can find one to cut and install glass in the door.. Home in Lakewood Ranch, Florida I wish I could find a class section lawsuit down here. I would definitely join.

    I would like to be contacted about joining a class action lawsuit against Lennar Homes. My house is one year old and I have cracked bricks, cracked back porch and many other poor quality items put in the home. I had an inspection completed before the one year expiration and they have all kinds of reasons why things don’t need to be repaired.

      I just bought my Lennar home in Las Vegas a little over a month and have many problems and issues with the craftsmanship of this home. Dealing with them is a joke! I would join a law suit if it was presented

    i am a 100% disabled vet living in a 2016 lennar townhome that i purchased. there are several issues concerning my safety and my family safety. I live in winter garden florida. Is there anybody in florida that can represent me. there are many disgruntle home owners.

    I just moved in to a new home in AZ and have had nothing but problems and I was lied to by the salesman on the next gen suite layout – when I went thru the first walk thru, I explained what the salesman said the kitchen was supposed to be and I was basically told ” that is not right , it has never been this way” but the model home showed it – is AZ a part of this – then 2 months later I have had a collapsed closet, bad door locks, water leaks , etcc… the list goes on and on .. I want them to be accountable for all the shortcuts they have taken in building these overpriced , bad construction homes

    We have lived in two different Lennar communities by chance. We rented both, thank goodness. Both were less than two years old. They are nothing above a more upright version of a manufactured home with improper sealing, HVAC systems and a whole lot more. The communities are usually in areas where there’s a tech culture. Many out-of-staters and foreign workers spend a whole lot of money for something that really isn’t going to appreciate. I watched so many people come in and they sold them a dream, like they do with Disney. It’s sad, really (I work in real estate so I’m sensitive to this).

        I’m so upset to her all that has happened to you & all these consumers and now me!
        I went into contract last September, 2017 not knowing that Lennar & Cal Atlantic were merging?
        The sales associated held back that information until we had to add more money for upgrades selection of appliances,tile,flooring etc. I had concerns of the quality due to being now Lennar,
        The sales person assure the all the material will stay the same as I saw in the model. After a month later sales associate calls me to tell me they have changed manufactor for the kitchen cabinets, but quality will be the same! Not!, different cabinets all together even the flooring tile is different!
        I had a walk through with the construction manager back in March and notice one of the bedrooms was significantly smaller than the model 2’feet smaller I ask the him why his response was this is the layout he had and change the conversation to confuse me!
        We had a delay of 3 months for the delivery of the home, June,17 original date of completion
        then July17 and now they are saying August 31st!
        Two weeks ago my husband visited the home and saw a disaster, there is no way they will be done by August 31 to many things need to be done! they abandoned our site to continue construction in 2 other homes down the street.
        I’m so angry I received a call this week 21 days of delivery from the design center saying the lights for all the bathrooms I had purchased for upgrade are no longer available, I’m not sure why it took them this long to order? back in February they had them in stock!
        they said they will put lights but if I want anything different I can buy them & install them my self?
        I have to pay now $2,000 for lights & hire an electrician? this is outrageous!
        At this point after hearing all these poor people having all these problems with Lennar I feel anxiety & depress from all this mess, I should not sign this loan walk out and loose the deposit!
        I fear worse things are going to come my way with everything that is happened to you ALL!
        I have no money to continue to fight this battle!
        I do not understand why there isn’t a Class action lawsuit against Lennar or Cal Atlantic why???
        Can we all get together & fight them???
