unum-lawsuit-denialUnum Life Insurance Company of America is facing a new claim denial lawsuit, this one from a Minnesota man alleging a wrongful Unum denied disability claim.

According to the claim denial lawsuit, the Unum denied disability claim was wrongfully assessed by third parties and was not subject to fair review.

Plaintiff Matthew C. had received notice of his Unum denied disability claim soon after conducting various efforts to get his claim approved. However, Unum denied his disability claim under alleged suspicious circumstances and Matthew adds that he had met all eligibility requirements.

Overview of Unum Claim Denial Lawsuit

According to the Unum claim denial lawsuit, Matthew had been fully employed by the United States SSI and was covered under Unum disability plans. According to these disability plans, Matthew would have been provided disability benefits if he became sick or injured at some point during his employment and proved that he would need the disability benefits for financial assistance.

These benefits were later needed, as Matthew became disabled with severe fibromyalgia on Nov. 20, 2001. After submitting the necessary documentation and medical testimony, Matthew had been initially approved for long term disability benefits and had received those benefits for over 15 years.

From the date of his disability through Nov. 21, 2016, Matthew received monthly disability benefits that were used for his medical treatments. This abruptly changed, however, when his approved status became denied. Unum denying the disability claim in turn ended his benefits.

Unum reportedly terminated his long term disability benefits on Nov. 22, 2016, stating that Matthew was no longer disabled under the disability plan. The disability giant had reportedly given no reason for the abrupt Unum denied disability claim.

Matthew has since tried to appeal this decision, but the decision was officially upheld on June 15, 2017. At all times relevant, Matthew has met all requirements for disability benefits and followed all administrative procedures when filing for the disability claim.

According to his claim denial lawsuit, Matthew was forced to quit his work due to his disability, as he was unable to perform his occupational duties. In addition, Matthew has been unable to work in a similar occupation or earn a sufficient income.

For patients to be eligible for disability benefits, they must prove they are physically unable to work in their jobs and also must show they lost a significant portion of their income directly because of their disability. Unum is currently facing over 3,000 claim denial lawsuits from policyholders, the federal government, and state regulators for alleged wrongful claim denials.

These claims allege policyholders were victimized by systemic claim denial tactics, which the disability insurance giant uses to deny claims to maintain profitability. Some of the claim denial tactics mentioned include subjecting disability claims to third party experts, who were directly hired by Unum for the alleged purpose of discrediting the claim.

Matthew had met all physical, medical and financial requirements necessary to receive long term disability insurance. At this point, Matthew has exhausted all administrative options and has been forced to file legal action against the disability insurance company.
