Kandoo-flushable-wipesTop Class Actions readers are starting to receive settlement checks in the mail from the California Kandoo Flushable Wipes class action settlement that claimed the product was incorrectly labeled as “sewer and septic safe.”

According to comments and posts on the Top Class Actions Facebook page, Class Members who filed valid claims for the California Kandoo Flushable Wipes class action settlement began receiving checks worth as much as $10 on Aug. 14, 2017.

According to the class action lawsuit filed in March of 2014, Proctor & Gamble Co. mislabeled its Kandoo Flushable Wipes as “flushable” because the wipes were unlikely to dissolve and disperse quickly. Those on sewer and septic systems, faced clogs and messy backups due to the false claims on the wipes’ packaging, the plaintiffs claimed.

The class action plaintiffs also alleged that California Class Members would not have purchased Kandoo Flushable Wipes if they had known they were not actually “flushable,” as claimed on the packaging. Alternatively, say the plaintiffs, they would not have paid as much for the wipes.

Class Members included anyone who purchased Kandoo Flushable Wipes in California from Mar. 21, 2010 to Dec. 9, 2016. The class action plaintiffs estimate that nearly 2.9 million packages of the Kandoo wipes were covered by this settlement.

Under the terms of the settlement, Class Members could receive up to $50 depending on the number of products purchased and whether proof of purchase could be provided. Class Members without proof of purchase could receive up to $10. Class Members with proof of purchase could receive up to $50 for their purchase of Kandoo Flushable Wipes.

Proof of purchase included itemized sales receipts or retail store club cards that included the purchase, price, date, and store where the wipes were purchased.

Proctor & Gamble also agreed to modify the product’s packaging by removing the statement “sewer and septic safe.” A statement warning consumers to flush only one or two wipes at a time and only if their sewer or septic system is well maintained will also be added to Kandoo Flushable Wipes packaging.

The deadline to file a claim for the California Kandoo Flushable Wipes class action settlement passed on Mar. 1, 2017.
