Kandoo-flushable-wipes

The Procter & Gamble Company and Nehemiah Manufacturing Company LLC have agreed to settle a class action lawsuit alleging they sold “flushable” wipes that were inappropriately marketed as “sewer and septic safe.”

If you purchased Kandoo flushable wipes in California at any time between Mar. 21, 2010 and Dec. 9, 2016, you may be entitled to payment from the class action settlement.

According to the flushable wipes class action lawsuit, the Kandoo products were not actually “sewer and septic safe” because the wipes were unlikely to dissolve and disperse quickly. This failure to dissolve allegedly made the so-called “flushable” wipes likely to clog toilets, drain lines, sewer pipes and sewage treatment facilities.

The plaintiff asserts that the defendants’ marketing of the Kandoo wipes as “flushable” convinced consumers to purchase the products when they would otherwise not have done so. The Kandoo class action lawsuit also asserts that the Kandoo wipes were sold at a higher price than they would have been sold without the misrepresentation that they were flushable.

The flushable wipes class action lawsuit estimates that approximately 2.9 million packages of Kandoo wipes were sold in California between April 2010 and October 2016.

The Kandoo class action lawsuit was initially filed in March 2014. The defendants filed a motion to dismiss the flushable wipes lawsuit, but the motion was denied in January 2015.

The defendants deny any wrongdoing but agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

In addition to providing a cash payment to consumers who purchased Kandoo wipes, Nehemiah also agreed to make changes to the labeling of the wipes.

The company has agreed to remove the phrase “sewer and septic safe” and add the following warning: “Flush only 1-2 wipes at a time. Use only in well-maintained toilets drain lines, sewer lines and septic systems.”

Class Members who would like to opt out of or object to the Kandoo flushable wipes settlement must do so no later than Mar. 1, 2017.

NOTE: The request must be received (not postmarked) by this date.

Who’s Eligible

Class Members of the flushable wipes settlement include anyone who purchased Kandoo flushable wipes in California at any time between Mar. 21, 2010 and Dec. 9, 2016.

Potential Award

Up to $10 without proof of purchase and $50 with proof of purchase.

The defendants have agreed to provide Class Members with a $1 refund for each package of Kandoo flushable wipes product purchased during the Class Period. Class Members who provide proof of purchase may claim up to $50, while Class Members without proof of purchase may claim a maximum of $10.

Proof of Purchase

Not required.

However, Class Members who submit proof of purchase may claim a maximum of $50 from the Kandoo wipes settlement. Class Members without proof of purchase can make a claim of up to $10.

Acceptable proof of purchase includes an itemized sales receipt or retail store club card that shows the purchase of a Kandoo flushable wipes product, the purchase price, the date of purchase, and the location of purchase.
