The teenage children of a surgeon killed when he was hit by a bus have been granted an award of $18.7 million, bringing an end to a major bus accident lawsuit.
Kayvan K. was a reconstructive hand surgeon and was just 51 years old at the time of his death. According to the lawsuit, Kayvan was killed while riding his bicycle when he was hit by a Motor Coach Industries tour bus. His family filed the bus accident lawsuit against MCI, alleging the company was responsible for Kayvan’s death because it had failed to give adequate warning about the vehicle’s dangers.
According to the bus accident lawsuit, the MCI bus involved in Kayvan’s death was designed in 1992. Though it was actually manufactured in 2007, it was essentially the same design as the old and outdated 1992 model. The bus accident lawsuit argued that the MCI tour bus was not safe, and should have been updated accordingly.
“Clearly, this 1992 design could have been benefited by these safety alternatives,” the attorney for the plaintiffs said.
Kayvan was killed in the bus accident in April 2017, leaving behind his wife and teenage sons. Unfortunately, his wife Katy died of cancer just a few months after her husband’s death, and their children were left to move through the bus accident lawsuit on their own.
After a day of deliberation over the bus accident lawsuit, the Las Vegas jury found Motor Coach Industries responsible for Kayvan’s untimely death. Each of his sons was awarded several million in damages, and the rest of the award was given to their parents’ estates.
