A legally blind man filed a class action lawsuit against the financial services company J.G. Wentworth, alleging the company does not make its website accessible to blind people using a screen reader.

Plaintiff Frank Senior filed the class action lawsuit against The J.G. Wentworth Co. on Nov. 4 in a New York federal court, alleging violations of the Americans With Disabilities Act (ADA).

Senior is a visually impaired and legally blind person who requires screen-reading software to read website content using his computer. 

According to the lawsuit, J.G. Wentworth failed to design, construct, maintain and operate its website, jgwentworth.com, to be fully accessible to and independently usable by Senior and other blind or visually impaired people.

“By failing to make its Website available in a manner compatible with computer screen reader programs, Defendant deprives blind and visually-impaired individuals the benefits of its online content, and services — all benefits it affords nondisabled individuals — thereby increasing the sense of isolation and stigma among those persons that Title III was meant to redress,” the J.G. Wentworth class action alleges.

J.G. Wentworth class action alleges website has multiple ADA access barriers

Senior says he tried to access the J.G. Wentworth website on several occasions to browse and possibly purchase one of its financial service offerings.

However, due to multiple access barriers, he was unable to. The barriers included lack of alt-text, empty links, redundant links and linked images missing alt-text, he says.

Senior looks to represent all legally blind people in the United States who tried to use the website. 

He seeks a permanent injunction to change the company’s corporate policies and procedures so that its website will become and remain accessible to blind and visually impaired consumers. He also seeks certification of the class action, damages, fees, costs and a jury trial.

This is not the first such class action to be filed.

Visitors hit Mercer University, Lafayette College and Loyola University of Chicago with class action lawsuits alleging their websites fail to offer full ADA accessibility to the blind or visually impaired.
