Apple Inc. recently admitted to intentional iPhone throttling, which the company stated was necessary to ensure that older iPhones would not suddenly shut down.

To prevent unexpected shutdowns, Apple rearranged processing power with their recent iOS 10 and iOS 11 updates and significantly slowed down phone functionality. Apple is facing a new iPhone class action lawsuit alleging this iPhone throttling made phones unusable and forced owners to purchase new ones.

Plaintiffs Donald L., Joel S., David J., James S., and Miriam F. are filing this iPhone throttling class action lawsuit on behalf of themselves and other similarly situated consumers.

The iPhones involved in the claim include models 6, 6 Plus, 6s, 6s Plus, SE, 7, and 7 Plus, each of which allegedly slowed significantly after the software updates were implemented.

Overview of iPhone Throttling Class Action Lawsuit

Each of the plaintiffs alleges that after downloading iOS 10 and iOS 11 updates to their iPhones, their phone started having delayed responses to commands and launching apps.

In addition, each of the plaintiffs allege the battery life of their phones drastically reduced compared to when they were purchased and that the phone functionality had buggy responses during ordinary use.

Due to the iOS 10 and iOS 11 updates, the claimants says they were unable to use the core functions of their phones including placing calls, using email, sending text messages, and using apps.

Donald and the other claimants also allege Apple failed to warn them that the iOS 10 and iOS 11 updates were permanent, and could not be removed from their phones.

However, even if the claimants had known that the updates were permanent, iPhone throttling may not have been avoidable because the iOS 10 and iOS 11 update notifications were constantly barraging the claimants’ phones with update notifications.

These pop ups would continue to appear, eventually forcing Donald and the other claimants to download the updates. The claimants were further incentivized by the promise of increased security on their phones.

However, plaintiffs claim the iOS 10 and iOS 11 updates ultimately ruined the functionality of the plaintiffs’ iPhones, forcing them to choose between contending with their current phones or purchasing new ones for at least hundreds of dollars.

The claimants opted to file the iPhone throttling class action lawsuit after Apple admitted to knowing about the problems with the iOS 10 and iOS 11 updates and that the iPhone throttling had been intentional.

Apple stated the throttling was necessary to prevent the phone from unexpectedly shutting down, due to the age of the battery and the phone being unable to keep up with peak demands for power. The iOS 10 and iOS 11 updates rearranged the phone’s processing to demand less power, which resulted in slower performance.

However, numerous consumers allege Apple intentionally concealed this information from consumers, driving them to buy new iPhones when the problem could have been fixed by replacing the battery.

    How do I sign up with this law suit ? My phone has been in its case sine the moment I bought it an I have had nothing but trouble with it it drops calls drops service says no service and I don’t get my texts or phone calls all the time and when it decides to work it is slow as hell unreal when I brought it to 2 Att stores and the first words out of their mouth was oh your gonna have to buy a new phone I said oh Hell No it isn’t gonna happen I shouldn’t have to buy a new phone because the phone that cost $600.00 should work just fine but it doesn’t , very mad

    I own an iPhone 6 and I kept on shutting down I get them going back to Verizon and they could not find anything over the phone. They replace my phone and I still have the same problems. Finally upgraded to the seven seems slower and delays all the time. My wife has a iPhone 6 and has the same problems. Let me know if somebody can help me with this.
