A group of eight plaintiffs has filed a lawsuit against Janssen pharmaceuticals and parent company Johnson & Johnson over Invokana kidney failure side effects allegedly resulting from the use of the diabetic medication.
Invokana is an oral diabetes medication used in combination with diet and exercise to lower blood sugar levels.
For some patients who have otherwise been able to control their diabetes, Invokana has been very instrumental in allowing them to recover their health.
For others, like those who have filed the Invokana kidney failure side effects lawsuit, the damages that patients have endured as a result of the drug, including a wrongful death claim, have caused a very different outcome for many patients.
Invokana is in SGLT2 inhibitor that inhibits glucose from being reabsorbed into the body and is instead excreted through the urinary tract.
However, serious side effects are possible with Invokana as they are with any drug.
Eight Plaintiffs File Invokana Kidney Failure Side Effects Lawsuit
The plaintiffs allege that the drug manufacturers “knew or should have known of the risks of diabetic ketoacidosis, kidney failure, and other serious complications based on the data available to them or that could have been generated by them…”
In addition to Invokana kidney failure side effects, the medication has also been linked to instances of ketoacidosis, a condition where too many acids buildup in the blood and cause a very serious situation.
Cardiovascular problems might also be connected to Invokana use.
The lawsuit states “Consumers of Invokana and their physicians relied on the Defendants’ false representations and were misled as to the drug’s safety, and as a result have suffered injuries included diabetic ketoacidosis, kidney failure, stroke, cardiovascular problems, and the life-threatening complications thereof.”
The first plaintiff alleges she suffered from diabetic ketoacidosis, and the second plaintiff alleges Invokana kidney failure side effects. The third plaintiff alleges diabetic ketoacidosis and dehydration, the fourth plaintiff alleges diabetic ketoacidosis and stroke and the fifth plaintiff alleges diabetic ketoacidosis as well.
The remaining plaintiffs allege that they have suffered loss of spousal companionship as a result of their spouses taking Invokana and suffering subsequent injuries.
Last year, the FDA issued several announcements regarding the safety of Invokana. In May, the FDA said that SGLT2 inhibitors could cause diabetic ketoacidosis.
In September they announced it could cause premature bone loss and fractures.
In October 2015, Canada’s Canadian drug regulatory authority, Health Canada, announced that Invokana could lead to acute kidney injury.
Currently, the Invokana label only warns of the possibility of ketoacidosis and does not warn patients of the potential of kidney failure or bone fractures.
Multiple counts were brought against the Defendants in the Invokana kidney failure side effects lawsuit including strict liability for defective design and failure to warn, negligence, breaches of express and implied warranties, fraud, negligent misrepresentation, loss of consortium, violations of state business codes and wrongful death.
The plaintiffs in this Invokana kidney failure side effects lawsuit are seeking general and special damages as well as equitable relief due to the severe medical conditions allegedly caused by the drug.
These include but are not limited to loss of earnings, past and future medical expenses, past and future emotional distress, punitive damages, attorneys’ fees and costs of the suit.
The Invokana Kidney Failure Side Effects Lawsuit is Case No. 37-16-00013788-CU-PL-CTL in the Superior Court of State of California, County of San Diego, Central District.
