Hi resolution render of vehicleA new class action investigation is looking into claims of Ferrari odometer fraud, after it was revealed that some car dealerships have been using an electronic diagnostic tool to rollback the miles on cars.

More specifically, the dealerships are accused of committing Ferrari odometer fraud  by rolling back the miles driven on the odometer to avoid selling the cars at a lower price.

The Ferrari odometer fraud allegations suggest that dealers may have significantly rolled back the miles on the car in order to increase the value of the used vehicle by thousands of dollars, which means car owners may be owed compensation.

This alleged Ferrari odometer fraud was discovered after a whistleblower lawsuit was filed by a Ferrari sales representative who claimed some Ferrari dealerships regularly used a diagnostic tool to rollback the miles on the odometers. This tool is called the Ferrari DEIS Tester, which can be used to roll back the odometers on used Ferraris to incredibly low numbers.

Allegedly, sometimes the odometers were as low as 0 miles, which allowed dealers to sell the cars at a much higher price. Now class action investigators are seeking Ferrari customers who may have been impacted by this practice.

There has already been a Ferrari odometer fraud lawsuit filed by a Florida man alleging he had purchased the vehicle when he had been under the impression the car had significantly lower mileage.

Overview of Ferrari Odometer Fraud Lawsuit

Ferrari is a well known popular automobile company dating back to 1947, when the Ferrari 125 S made its entrance into the market and was meant to represent “the passion and determination of the company’s founder.” Ferrari vehicles are known for being very expensive, so when car enthusiasts see a used one for sale they are automatically enticed by the potential opportunity to own one.

However, potential buyers only want to pay a fair price for the car based on its condition, including the number of miles recorded on the odometer. The Ferrari odometer fraud lawsuits allege that Ferrari rolled back the miles on the odometers so they could sell the cars at a higher price.

This alleged practice was exposed by whistleblower Robert “Bud” Root, who filed legal action against the car company for wrongful termination. Root alleges Ferrari fired him for his age and for exposing his dealership’s practice of rolling back odometers.

However, Root further alleged the Ferrari odometer fraud was systemic, as the Ferrari’s DEIS Test devices required online authorization from the car company. Root’s Ferrari odometer fraud lawsuit also references a 2015 Ferrari LaFerrari owned by Stephen McMillian, whose vehicle’s odometer had allegedly been rolled back to zero in 2015.

The lawsuit further alleged that the slightest rollback of the odometer, could increase a car’s value by a significant amount of money. According to a Technical Bulletin published in the Daily Mail, Ferrari North America acknowledged that it was aware that the Ferrari DEIS Tester was being used to tamper with odometers.

However, Ferrari has admitted to no wrongdoing and states the diagnostic tool does not work for cars with an odometer reading of over 311 miles. Consumers who are potentially impacted by the alleged Ferrari odometer fraud scandal may have overpaid for their vehicles and may be eligible for compensation.
