Hyundai Sonata Defective Braking System Class Action Lawsuit
By Matt O’Donnell
A group of Hyundai Sonata owners have filed a class action lawsuit against the automaker claiming that its 2006 to 2010 Sonatas have defective brakes and Hyundai won’t back up its warranty on them.
The Sonata owners claim in the class action lawsuit that these model year Hyundai Sonatas are equipped with defective braking systems that cause “significant squealing” and premature deterioration of the rotors and pads, and of the ability of the calipers to stick and bring the vehicle to a stop.
“These defects are unreasonably dangerous, as they can cause the braking system components to become severely worn and damaged, and may lead to a complete failure of the braking system,” the Hyundai Sonata class action lawsuit states.
The Plaintiffs claim Hyundai “was on notice” that the Sonata’s brake assemblies were defective and unfit due to customer complaints and their own testing, yet “actively concealed the existence and nature” of the Sonata brake defects to consumers at the time of purchase or thereafter.
In addition, “Hyundai has not recalled the Sonata to repair the defects, nor has it offered to repair the defects to its customers free of charge, nor has it offered to reimburse Hyundai owners, present or past, who incurred costs relating to the braking system repairs,” the Hyundai Sonata class action lawsuit says. Hyundai is also accused of fraudulently telling Sonata owners that their warranty doesn’t cover the braking system defect.
The Hyundai Sonata brake defect class action lawsuit is brought on behalf of all New York citizens who purchased or leased a 2006-2010 Hyundai Sonata in the state of New York. It is seeking triple the amount of damages suffered by the proposed Class, in addition to legal fees, for breach of contract, unjust enrichment, breach of implied warranty of merchantability, breach of express warranty, and deceptive trade practices.

Are there any updates with this post? I had to replace my rear rotors and break pads last month. I now am replacing them again due to caliper issues. I have a 2010 Hyundia Sonata.
I have a 2007 Sonata, and recently the rear caliper froze to the rotor for no apparent reason. Took to the dealer and both the Pads and Calipers had to be replaced. Dealer said this is normal for this vehicle and did offer any financial assistance.
I had a 2006 Hyundal Elantra.(The reason I am posting here is I do not believe there were very many Elantras in 2006 with ABS and 4 wheel disk brakes.) I had a 2006 Hyundai Elantra with 4 wheel disk brakes and ABS. It was the only one on the lot at the time but I wanted ABS. MISTAKE 1, MISTAKE 2 I bought it. At around 11,000 I had complete right rear brake failure and was almost involved in a crash. I had been to the dealer several times and was told the noise I was hearing was normal. I guess it was not normal. I went back to the dealer but was told brakes and parts were not covered by warranty. I had it repaired, complete disk, rotor and other parts. Not at Hyundai but I guess they would say it is not their fault. By 21,000 the same thing happened. I got rid of it. I am on Social Security and do not have a car now. When I brought it I was told the vehicle was care free. They even would not sell me the car without some type of warranty plan which I refused. They deducted something so they could sell me the plan but it did not cover brakes. The whole thing should be criminal. HYUNDAI SUCKS!
I own a 2010 Hyundai Sonata had my car serviced and the brakes were checked. Was told to have them rechecked again on next service visit. Had to replaced the rear brakes three weeks later. The calipers are causing the brakes to wear. Very unhappy!!!!!
I own a 2007 Hyundai Sonata and have replaced my pads, rotors and calipers on front and back numerous times, I recently replaced the rear caliper on the rear passenger back side…Tired of it and it gets costly. How do I get in on the lawsuit..
I have a 2010 sonata and for the first two years everything was great. In the past 2.5 years however I have had to have my breaks and rotors fixed four times. They are messed up now and they say that i have to get my rear calipers replaced now. Dealership states the repairs would cost $1000 to fix. I’m putting that money down on a new car.
