Two consumers claim in a new class action lawsuit that Huffy Corp. sold defective Tonka Dump Trucks that pose a burn hazard to children.
Plaintiffs Turneshia Hartsfield and Robin Domrzalski filed the class action complaint against Huffy on April 30 in Ohio federal court, alleging violations of state and federal consumer laws.
The plaintiffs allege Huffy’s Ride on Tonka Dump Trucks were sold with a defect that can cause the controller to overheat, posing a burn hazard to children who operate the toy.
According to the lawsuit, Huffy sold approximately 23,600 of these defective trucks between June 2023 and March 2025 at a price of around $300 each.
Hartsfield and Domrzalski claim that other manufacturers produce similar toys without the overheating issue, suggesting that the defect in Huffy’s products was avoidable.
Consumers say Huffy’s recall remedy inadequate
The two say they purchased the trucks without knowledge of the defect, and that they experienced problems with the toys after purchase, including one truck that started smoking.
They allege Huffy’s recall of the product is inadequate, as the company is only offering a replacement remedy and not refunds to consumers, and argue that they and other consumers bargained for a safe product but were instead sold a dangerous fire hazard.
Hartsfield and Domrzalski seek to represent a nationwide class of consumers who purchased the defective trucks. The plaintiffs are suing for unjust enrichment, breach of express and implied warranties, fraudulent concealment and negligence. They are seeking damages and equitable relief on behalf of themselves and the proposed class.
In related news, Yoto recently re-announced a recall of more than 270,000 Yoto Mini speakers due to lithium-ion batteries overheating and posing fire and burn hazards.
