hawaii-resort-feesWhen planning vacations, travelers expect that they can forecast their hotel bills by multiplying the room rate by the number of nights they will stay there. However, on Maui, Oahu and other islands, Hawaii resort fees are increasingly common, but that does not mean that they are necessarily legal.

Many people may not realize that checking a box on an online reservation form or signing the same slip at the front desk constitutes a contract, but it does and hotel fees class action lawsuit attorneys are investigating whether or not these resorts are in fact a breach of that contract.

Charges can rage from $5 to more than $35 and while some include benefits such as parking, DVD players and discounts at local attractions, still others simply tack on a mandatory fee for amenities.

Local travel websites noted that growing trend several years ago, and in fact a key selling point for some hotels in the islands is that they do not add Hawaii resort fees when guests check out. Others have decided that rather than charging up to $30 or more per day, they will simply implement a per-stay rate. For those that do, however, they may become the target of a hotel resort fee class action lawsuit depending on when customers were informed of the tacked-on charges.

Many travelers claim they were surprised by these mandatory fees because they were not advised of them prior to checking out of the hotel. That confusion and shock may be a sign of a breach of contract. After all, potential resort fee class action lawsuit plaintiffs may have acted differently had they been aware that they would be paying much more than they bargained for when they initially made the reservation. This and other factors will play a key role in whether or not vacationers have a legal remedy available to them.
