Electronic Toll Collection

While tolls on bridges and highways used to be charged in cash payments, modern technology has evolved the system to offer electronic toll collection options. With these systems—which include EZPass, FasTrack, SunPass, MDX, and iPass, among many others—drivers can pay their toll fees without stopping at a booth or scrambling to find spare change.

There are a few ways for an electronic toll to be collected. Many drivers outfit their vehicles’ windshield with a transponder device, which automatically records information and incurs a toll when the vehicle passes through a toll marker. If drivers do not have a transponder or appropriate account, then their toll will be recorded by license plate: an overhead camera takes a picture of the plate, and a bill will be sent to the car owner’s address.

Drivers may incur a toll roads violation if they fail to pay tolls or otherwise violate the rules of this system. However, some drivers claim that they are being charged improper or excessive toll roads violation fees.

Improper Toll Roads Violation Fees

Drivers have reported a number of improper toll roads violation fees for a variety of issues, including failing to maintain adequate account balance, using toll-by-plate or toll-by-mail options, and other things.

According to drivers, these toll roads violation fees are often grossly out of proportion to the tolls themselves. For some, these toll roads violation fees can be excessive, reportedly leading to owing thousands of dollars in fees—and this may happen even without the driver’s knowledge.

Some drivers say that they were not given adequate notice of the toll they had allegedly incurred, but were still assessed one of these toll roads violation fees. In some cases, unpaid toll roads violation fees may be passed to collections, or even result in a registration hold on their vehicle.

But drivers claim that the toll roads violation penalties they’re hit with are far greater than the toll fee itself. Drivers using New York’s electronic toll collection systems, EZPass and Tolls-By Mail, claim that they have been charged $100 fees for violations, even though the actual toll fee costs less than $10.

On top of the excessive fees, some drivers claim that they are not informed about the issue until weeks after the fact, meaning that can continue to rack up late penalties and other expenses for the same violations in the interim without knowledge that there is a problem at all. In the worst cases, drivers may end up with thousands of dollars in unpaid toll roads violation fees.

    I am getting an error when I click on Learn More. I have been charged even though I have NEVER utilized the toll roads. They state they can not provide photo proof because they are not toll evasions. Is there going to be a lawsuit I could join for Class Action, or should I seek legal assistance elsewhwere?

    Is there a law firm that is actually filling a class action against the toll road company. We had a bill that they claim they could not reach us so the compounded bill was $330 for the $6.50 toll. Having the problem of not being able to renew the car we paid it. Then today low and behold a toll from 2017 now two months later, surfaced and that $12.00 toll is $860. But they said they would take $460 if we paid it today. Its a scam which is now being backed by the state of Colorado. With COVID 19 its even worse for people but having the state allow them to lean your car without any way to contest it is nothing more that a state sponsored scam.

      I’m having issues and they are overcharging as well and when confronted lie. I have pictures to prove part of it and want to sure then but looking for a class action suit here in Colorado. If you’re interested and know anyone else maybe we can find an attorney here to take the case

      The bill did not come to my residence until after it Accumulated ridiculous fees. Aside from the fees, it’s next to impossible to get someone on the phone to resolve the bill. As a single mom with limited resources this bill is a great inconvenience to me and my family. It’s unfair that a $8.50 poll bill is increased by a $100.00, this is totally uncalled for.

    Being over charged for tolls at pay by plate rate when I have a transponder. Customer service at ezpass refuse to help resolve issues or reimburse me for the over charges.

      Yes my toll bill was a minimum of $18 with the Coronavirus Pandemic going on they put my bill from $18 from a couple of months to over$245 and there’s no work because of the Pandemic strain.. ridiculous $25 to $75 fees for late fees.

    I was just told I had an excessive amount of violations which resulted in a LARGE amount that I am told I owe and unfortunately it went to DMV so on top of the Toll Fees, I now have to pay that in full in order to have my Renewal done by THIS JUNE
    2020! The Violation Feed are ridiculous!

    I live in California. I drove the toll road on Jan 14th. I received a bill for $6.33 and $7.92. (one for each way) On Feb 9th I went into the system to pay it (30 day grace period with no late fee). My card was accepted for the $6.33 toll. I then went to pay the $7.92 fee and the system kept rejecting my card. This is the same card that was used to pay the $6.33 fee. My bank also sends me a text every time I use the card and I received TWO separate texts saying I was charged twice for $7.92. But the toll road system kept saying the card didn’t go through. Not sure what was happening, and to be safe, I set up an official account with the toll roads, entered the same credit card and it said that all tolls would be taken care of automatically. I went on my way assuming everything was taken care of, being that I received two texts from my bank saying the $7.92 had been charged and I set up an autopay account for all charges just in case. A month later, I now receive a bill for the $7.92 with a $100 fee!! I called them and the toll lady was able to see that I tried to pay twice. She said I actually tried to pay 3 times and because I entered the date wrong on the first try, the system is set up to reject additional tries. Seriously??!! That’s a scam! SO even when she could see that I entered it correctly twice, the system rejected it SO THAT it could say I didn’t pay SO THAT it could charge me a fee. So then I asked about the auto pay I set up to auto-pay all fees and she had no explanation for why that didn’t take care of the charge on my account. I have a reason…… SO THAT it could charge me a $100 fee. Such a scam. A class-action lawsuit is necessary at this point as I guarantee I am not the only one who is being scammed by a system that is intentionally set up backward SO THAT it can charge fees. Similar to the Bank of America lawsuit a few years ago. It is time the Toll Roads were held accountable for a scam based system.

    I live in Ventura County, California. I just received a “citation” from the South Bay Expressway stating that I was on their toll road on 1/3/2020 on my Harley motorcycle. I was working that day and can prove it. My motorcycle is kept in a locked garage, where it still is to this day. I haven’t even been to Orange County in over a year. I was not provided with a photograph of the errant toll road event to properly dispute this and their affidavit dispute form has no provision for the circumstances I’ve listed. Even with a dispute by mail, which they state is the ONLY way a dispute can be filed, the “citation” is decided by an administrative team and not in court.

    I’m very frustrated by this whole fake-legal process for extracting money from innocent people for things we haven’t done.

    I live in TX. I have $100s in toll fees. I never received the initial bill. Now I have been issued a citation by the state and have to pay that fine. I actually did not even take the toll road, someone who borrowed my car was inconsiderate. I have have 4 collection agents trying to bill me and I don’t know who yo psy. This all just compiles the issue. It’s giving me so much anxiety and I’m already too broke to afford Christmas for my kids and grand kids. What can I do to fight this?

    The toll roads are claiming I owe them $160,000. I have begged, spent hours on the phone with them, went in person, wrote letters, sent emails and my attempts to resolve this issue have been unsuccessful with them. They have worked out arrangements that were ridiculously unreasonable for a single mother of 2 kids, on one income, and going to school. 3 years ago, I went through a terrible separation/divorce from a highly abusive person, and my kids and I went through a long period of emotional turmoil. As a result, I was also diagnosed with anxiety and depression. When I was driving on the tolls, I did not have the transponder but I chose to be billed once a month with my billing information included. I should have chosen to get a transponder but I went this route. I did not stay on top of this bill, and truthfully I didn’t stay on top of other bills. Things sort of slid out of control during this time as I was trying to comfort my kids, hold down a full-time job, attend classes, and go through court proceedings with my ex. I can prove all of these things too if need be.
    I completely hold myself accountable for not paying my bills on time, but the thing is, when the fees climbed and got out of control, first it was $26,000, then it skyrocketed to $48,000 then it became $160,000, each time I tried to work out something that was manageable, explaining my situation each time, and showing my income, and the answer was always “no” to what I could afford. They wanted $500 to $800 monthly payments. The amount would vary depending on who I talked to.
    I would like to take ownership of the tolls that I have failed to pay, which the actual amount I owe is roughly $5000. The rest is in disciplinary fines (approx $160,000 of fines alone)

    Today: if I need to take the tolls, I pay them right away. Unfortunately, I am driving a car with expired registration because I have a DMV hold. A friend of mine reached out to the toll roads, and offered a settlement of $7,000, they gave no clear answer to whether or not they would honor that. Instead they sent me documents to fill out, which is a form to list all of my expenses, and they asked for W2s, pay check stubs, and tax returns. I sent it in, hoiping this would show that I cannot afford $160,000. They called recently and asked for 3 months of bank statements, child care cost proof, car insurance proof, medical insurance proof, proof of all utilities, rental agreement…basically anything and everything that proves how I spend my income as well as proof of my situation. I question whether or not this is even ok. I am willing to come to an agreement with them, but I feel like they are reaching too far into my personal life. I mean, with my W2, my paycheck stubs, and my tax return…I would think that they can gather the fact that I cannot afford $160,000.

    I really need help. I have no idea what to do at all about this. I would appreciate any answers, guidence or support from anyone! :) Thank you for reading!

      omg! That’s just insane. Mine was 26,000 from 2018-2019 with no warning I had a hearing with DMV and Ezpass via Zoom i gathered all my statements of payment to turn out after taking a day off from work that the hearing wasn’t to fight my case it was to see if the address matched dmv and ezpass that is how the ” trackable mail” mail I never got. I called suspension unit they sent me 40 pages of bullshit and told me they will give me 80% off it I pay today I told them send me an invoice they never did gave me 10 days to pay or registration will be suspend. I had no choice to pay 6 grand or else my husband will loss his job he needs to cross the bridge every day. took the 4 years to send this with no warning in between with a active ezpass account. what they are doing is not right it literally made me sick
