The claimant has filed legal action on behalf of her deceased loved one, alleging asbestos related mesothelioma ultimately resulted in the development of the deadly respiratory cancer.

Asbestos is a fibrous material that was popularly used for construction and manufacturing purposes before the 1980s. The material reached its peak in popularity during World War II, by being used for insulation purposes. Asbestos was widely used during this time for its fire and chemical resistant qualities, as well as for its low cost.

However, asbestos has been labeled as a carcinogen by the International Agency for Research on Cancer (IARC), which reconfirmed asbestos related mesothelioma was a significant risk to certain occupations and veterans in March 2009.

The agency stated asbestos exposure was the primary cause of mesothelioma, along with other forms of asbestos related illness. Two years later, the IARC had presented proof that asbestos was a carcinogen and presented a cancer risk regardless of exposure duration or fiber length.

Manufacturing companies are now required to disclose this information to consumers and employees if any of their products or equipment contain asbestos. In the case of Teri’s asbestos mesothelioma lawsuit, Georgia-Pacific LLC allegedly failed to do this.

Overview of Asbestos Mesothelioma Lawsuit

Plaintiff Teri H. is filing on behalf of the late Rodney H., with the asbestos mesothelioma lawsuit filed on May 11, 2017. The claim is naming Georgia-Pacific LLC as defendants, formerly called Georgia-Pacific Corp., with Teri alleging multiple counts of negligence.

According to the asbestos mesothelioma lawsuit, Rodney developed asbestos related mesothelioma and ultimately died on April 11, 2014. Mesothelioma is a very rare form of lung disease specifically caused by asbestos exposure, in which asbestos fibers become lodged in the mucus lining of the lungs.

This disease often takes decades to progress to the point of developing symptoms, often resulting in late diagnosis and limited treatment options. Rodney had been allegedly exposed to products containing asbestos on a daily basis, and he allegedly received no warnings or disclosures from Georgia-Pacific LLC.

Teri alleges Georgia-Pacific LLC either knew or should have known about the potential risks associated asbestos exposure, and should have provided warnings to the public.

Teri is requesting a trial by jury and is seeking punitive and exemplary damages, along with any additional interest. At this time, there are other asbestos mesothelioma claims and asbestos injury class action lawsuits being processed across the country.

Wrongful death claims like these are often filed by the loved ones of individuals who were exposed to asbestos at some point, and later developed asbestos related mesothelioma or other disease. Most cases of asbestos mesothelioma claims occur at least 15 years after initial exposure, but mesothelioma can take up to 50 years to show any symptoms.
