credit card ZIP code class action lawsuitIn an effort to encourage more than a million owners to bring in for repair General Motors vehicles with faulty ignition switches, the auto-manufacturing giant is offering $25 gift cards.

Drivers whose cars are fixed by Jan. 1, 2015 can choose gift cards to Amazon, AMC Theaters, Applebee’s, Bass Pro Shops, Red Robin, Starbucks or Wal-Mart.

Time magazine reports that just more than half of the 2.6 million GM vehicles recalled in early 2014 have been repaired, meaning more than a million potentially defective cars – about one-third of them are people with children — remain on the road “in cars that can suddenly turn off or suffer from disabled steering, brakes and air bags.”

In addition to a plethora of media publicity about the GM ignition switch recall, an “ominous-sounding recall letter” sent to owners, Facebook and Twitter messages, and phone calls to consumers, 1.26 million vehicles with the unrepaired ignition switch defect remain in service.

The massive recall has spawned inquiries by the Justice Department, a Congressional committee and the National Highway Traffic Safety Administration as well as two class action lawsuits filed on behalf of 30 million GM consumers accusing the automaker of lying about the safety of its vehicles both before and after GM filed for Chapter 11 bankruptcy.

The GM recall class action lawsuits allege that more than 60 recalls affecting more than 27 million GM cars and trucks sold in the United States for model years 1997 to 2014 have caused consumers to lose value in their vehicles.

General Motors has also set up a defective ignition switch compensation fund, which as of mid-October had approved 29 death claims and 27 injury claims. The total number of claims filed as of Oct. 17, 2014 was 1,517, 184 of which were death claims. Ninety-three claims were made for serious injuries and 1,240 for less-serious injuries is 1,240. The fund is accepting claims through Dec. 31.

According to GM, under certain conditions, the ignition switch of the affected vehicles may move out of the “run” position, resulting in a partial loss of electrical power and turning off the engine. This risk increases if the key ring is carrying added weight (such as more keys or the key fob) or the vehicle experiences rough road conditions or other jarring or impact related events. If the ignition switch is not in the run position, the air bags may not deploy in the event of a crash, increasing the risk of injury or fatality.

Additionally, the ignition key may be removed when the ignition is not in the “Off” position. When this happen, “unintended vehicle motion may occur: (a) for an automatic transmission, if the transmission is not in “Park”; or (b) for a manual transmission, if the parking brake is not engaged and the transmission is not in reverse,” according to GM.
