GM class action lawsuit overview:
- Who: Plaintiffs Barbara Figlio and Morris D. Gordin filed a class action lawsuit against General Motors (GM), OnStar, LexisNexis Risk Solutions and Verisk Analytics.
- Why: GM and OnStar collected driver data without consent and shared it or sold it to LexisNexis Risk Solutions and Verisk Analytics, the GM class action lawsuit claims.
- Where: The GM driver data class action was filed in federal court in Georgia.
Yet another GM driver data class action has been filed over claims that General Motors and OnStar collected driver data without consent and shared it or sold it to LexisNexis Risk Solutions and Verisk Analytics.
LexisNexis and Verisk are consumer reporting agencies that use the driver data to create a risk score that they share with insurance companies without driver knowledge or consent, according to the lawsuit.
“For the most part, drivers who were subjected to this unauthorized intrusion into their private data experienced a concomitant increase in their insurance premiums presumably based upon this private driver behavior data or telematics provided to LexisNexis and/or Verisk, thereby causing them damage,” the GM class action claims.
GM class action: Company collected variety of out-of-context driving events, used it against drivers
GM collected data such as average speed, frequency and intensity of acceleration and braking, percentage of time exceeding 80 miles per hour and late-night driving habits, the GM driver data class action says.
The lawsuit alleges that the data is taken out of context by the agencies, and that it both led to increases in their insurance premiums and prevented them from acquiring less expensive insurance from other providers.
The OnStar Smart Driver Plan is marketed as a way to improve safety and the driving experience but it actually is a way for the companies to invasively collect consumer data for sale to third parties, the lawsuit claims.
Another consumer filed a Kia class action lawsuit claiming that automaker also collects driver data and sells it to third-party companies such as LexisNexis Risk Solutions without drivers’ full consent. Similar claims are also being investigated against Honda, Hyundai, Kia and Subaru.
