  • On Aug. 28, a 6th Circuit panel rejected GM’s motion to dismiss the claims, saying it found no reason to undo class certification for the drivers.

A group of 13 consumers claims certain transmissions in General Motors vehicles from the last decade are defective and can create unsafe driving conditions, according to a new GM transmission class action.

The plaintiffs say GM’s Hydra-Matic 8L90 and Hydra-Matic 8L45 transmissions manufactured between 2014 and March 2019 can cause vehicles to shudder, lurch forward or have delayed acceleration.

They allege the issues are caused by transmission fluid issues, which can allegedly cause the GM transmissions to fail to purge air properly from valve bodies. This, the class action argues, is the cause of the shudder, lurching and delayed acceleration, as well as overall poor shift quality.

GM class action: Automaker elected not to recall, replace defective transmissions 

The GM transmission issues happen around the time the affected vehicles’ warranties run out, the class action claims. The plaintiffs allege that GM covers fluid flushes for customers who complain about their transmissions during the warranty period, without fixing the underlying issues.

GM engineers asked the company to fix the transmission issues for $305 a vehicle, which would have cost GM about $592 million, according to the lawsuit.

GM instead only replaced the defective transmission in 6,518 unsold Cadillacs and trucks in certain states where it expected customers to complain within warranty, the GM class action claims.

Six drivers filed a 2022 class action lawsuit alleging that several vehicles manufactured by GM are equipped with defective eight-speed transmissions and that GM concealed the defects from buyers for years.

    My 2018 GMC Sierra has the same issues GM flushed my Transmission but it still shutters and slips gears this has been ongoing since 2019 I have complained multiple times but was told that this is the way these Truck Transmissions work I know that they are not doing what needs to be done to fix my Truck but NOBODY from GM seems to care Thanks

    Recently purchased a 2015 GMC Sierra, 4.3l. This transmission exibits the same symptoms as indicated in the class action lawsuit. I want to join!

    2017 Sierra here. I’ve complained about the transmission multiple times. They finally did the fluid change to the Mobil synthetic which didn’t seem to make it any better.

    I have 2018 chevy truck and the transmission has shutter and acts weird during excellerating and stopping. I paid alot of money for a defective transmission

    I have a 2014 chevy silverado transmission shutters vibrates causing me to miss work due to I’m scared to drive it. I have contacted chevy home office. They seemed like they was going to help but here in Rome Ga they have some rude people here at this dealer ship. Who don’t care if they sell you stuff that’s broke they still want you to pay to fix what’s there problem. I’m glad there’s a class action suit add me to it also! I want my truck fixed and to be reimbursed atheist some of the money my construction business has lost.

      I have a 2016 Z71 LTZ Had the transmission rebuilt by the dealer after owning the truck for only 5 months. It is worse then what it was before the dealer rebuilt the internals. I will be joining this class action suit as I am paying almost $60k for this defective vehicle

      I have a 2016 gmc Sierra with the 8 speed, started shuttering at approximately 70k. Cost me 350 to get the tranny serviced, only days before the extended warranty ran out…fingers crossed. I was told a new one would cost 8k plus labor

    Purchased a 2015 GMC Yukon XL Denali 4×4, 6.2, 8L90E. Have had 3 torque converters for shuddering, a updated program from GM, a new valve body and and always have had shift, acceleration issues, along with hard down shifts. Vehicle is extremely well maintained and currently has 265k miles. Transmission now bangs into reverse buy forward gears are alright or normal for this vehicle. Spent many dollars on transmission repairs!

    Yes I own a 2017 Cadillac CT6 with 65k miles. It too has developed the shudder and lurching described in the class action.
