TCPA LawsuitThe Telephone Consumer Protection Act (TCPA) is designed to protect consumers from companies with robocall programs as well as text message spam. While many firms who have settled these types of cases are otherwise engaging in lawful endeavors, enterprising criminals have hit upon the practice as a way of bilking people out of money.

Companies prey on that with an unsolicited robocall and are hopeful that if they talk with enough people, they will make money. However, the new concept of spoofing is a troubling one because a name is not the only thing that people who may later file a robocall lawsuit are willing to trust.

It’s not uncommon for family members, co-workers, doctors and more to have similar phone numbers. Criminals are taking advantage of this by having a local number show up in the caller IDs of landlines and cell phones. They then try to seek out personal financial information and cases of identity theft are skyrocketing around the country.

However, it is important to note that additional illegal activities are not a requirement in order to seek statutory damages of up to $1,500 for each violation in a TCPA lawsuit. The Telephone Consumer Protection Act only requires that unwanted communications be made from an automatic telephone dialing system in order to file a robocall lawsuit or one regarding text message spam.

Still, best practices for either type of illegal act are the same. Do not pick up if the number is unfamiliar to you and keep track of any unsolicited text messages. You may also be able to check online to see if other consumers have the same issues from a given number.
