Ford transmission mass action lawsuit overview:

Ford Motor Co. knowingly sold Ford Fusions and Ford Escapes with defective transmissions, according to claims made in a 533-page Ford mass action lawsuit filed March 20 in Michigan federal court.

The Ford transmission defect allegedly affects model year 2010-2020 Ford Fusion and 2009-2021 Ford Escape vehicles.

“Ford repeatedly lied to consumers as to the reasons for the problems consumers experienced,”  says the lawsuit, which has already been joined by more than 100 plaintiffs. “As a result, consumers were and are stuck in unsafe Fusion and Escape autos that have costly repairs and minimum resale value” allegedly due to the Ford transmissions defect.

The automaker allegedly knew the Ford transmissions in its Fusions and Escapes had a defective condition that could manifest in violent jerking, delayed acceleration, difficulty stopping, hard decelerations, premature wear of the internal components and potential catastrophic failures.

Ford transmission defect due to ‘fundamental design failure,’ plaintiffs claim

The Ford transmission defect is the result of a “fundamental design failure” in the interconnected array of software and hardware systems that allow the transmission to operate, the Ford lawsuit alleges. 

Had the plaintiffs known about the Ford transmission defect and the potential for premature failure, they would not have purchased or leased the affected vehicles, according to the mass action lawsuit.

As a result of the undisclosed Ford transmission defect, the plaintiffs claim they experienced financial losses, including but not limited to out-of-pocket costs related to repairs, costs of obtaining alternative transportation and decreased value of their vehicles.

The plaintiffs also claim they suffered harm because their vehicles’ transmissions and related components “are substantially certain to fail before their expected useful life has run,” the Ford lawsuit alleges.

Ford recently reached a $365 million settlement with the U.S. Department of Justice over allegations it put a sham row of back seats in cargo vans to avoid a 25% duty rate.

    Bought my 2017 Ford Escape with a little over 71,000 miles on it did regular maintenance,change the oil and transmission fluid you know all the stuff you would do to keep the car running good. Took a work trip to Alabama get home go to take it to get the oil changed and make sure everything is running smoothly started have some issues with the transmission get it to the shop they check it change all the fluids. We leave get down the road and still having issues didn’t even make it home and the transmission completely went out wasn’t going anywhere. Called the shop they had it towed to a different shop that only works on transmission and they said I need a new transmission it only has a little over 77,000 miles. I have never had a car that’s transmission went out that fast . Contacted ford about this issue and they said that them transmission have had issues but they weren’t going to do anything about. This is completely wrong for them to know there is issues with these transmission and not do anything about it . It’s going to cost me $3500. – $3700 to get it fixed. I still owe over $4,000.00. Paying on a vehicle I can’t even drive!!!!

    My 2017 Fusion needed a new transmission in October 2023
    Went to the dealer and they put in a rebuilt transmission, warranty was three years or 100,000 miles.

    My 2020 ford fusion transmission completely failed with no warning on March 7th ! No smells no jerking before hand nothing we made it all the way to the Detroit zoo smoothly and it just started to slow down on us as soon as we pulled up to the parking lot. It wouldn’t accelerate at first so we turned on and off the car hoping it was the battery because I kept having a warning on my phone about the battery but my car never seemed like the battery was bad. Once we turned back on the car and put it in drive that’s when it jerk for the first time EVER and a yellow wrench popped up with the door ajar symbol (no door were open) but the check engine light never came on, no warning signs, no burning smells, the car never shake, nothing besides what popped up on ich was a powertrain issue after the fact. It’s going to cost me over 4000 to fix it and I still owe over 19 thousand on this car and the car only have around 130 miles on it

    We purchased our 2016 Ford Escape SE new, was regularly maintained when all.of a sudden, last week, it started jerking, shuttering. We took it in right away to have it diagnosed. Said we needed to possibly flush it. While taking it back to the auto shop, the transmission went out. Absolutely made no sense as we have all of our records of maintaining the vehicle. The transmission should not go out in 10 years.

    My 2017 Ford Escape transmission completely failed and left me stranded. I bought the vehicle with additional insurance and a warranty from Adonis Motors in Houston. The vehicle had 107k miles and was maintained Adonis wanted $3700 to fix the transmission and denied I had the additional coverage and they left my vehicle to be pillages at a shop and sent it to auction as a repo after not returning my calls or answering my emails. Adonis admitted the Ford had transmission failure and they didn’t want to pay for it and said “contact Ford.”
