all natural class action lawsuitAcross America, numerous food companies are following the organic and “All Natural” food trend that focuses on better living and healthier eating. Experts believe that this stems from the ever-growing population of consumers who have become more considered with physical appearance and overall physique.

One of the most notable natural food products is Pipsnacks, which is a healthy batch of popcorn that is popped by a health popcorn company in New York called Pipcorn. The creators behind it, Jen and Jeff Martin, had created this product as a desire to make a perfectly healthy snack that was all natural, gluten free, vegan, whole grain, and contained no GMO (genetically modified) ingredients. These all natural food labels automatically generate a preference in the market for customers who desire to live a healthy and active lifestyle.

A number of other companies are adhering to the all natural food trend, in order to reach out to the rising target market of healthy living. Some of America’s biggest food companies are trying jump on the band wagon of the “All Natural Label” in order to adhere to the overall consumer demand including:

  • Kraft: The company recently announced that it will remove the artificial orange and yellow dye used in their popular macaroni and cheese products. By 2016, the artificial colors will be replaced with natural ingredients including: turmeric, paprika, and annatto.
  • Tyson Foods: This company recently announced that it will stop using antibiotics in its chicken, which will take two years up tp address growing problems with antibiotic resistance.
  • Chipotle: The company now only using non-GMO ingredients in all its food.
  • Panera Bread: This company plans to remove and replace more than 150 ingredients including artificial additives and preservatives like MSG, which is set to be completed by the end of 2016. Additionally, the company is set to replace all its salad dressings made with artificial sweeteners, flavors, colors, and preservatives.
  • McDonalds: The company plans to simplify its chicken recipe by removing ingredients like maltodextrin, which is a sugar that adds flavor and increases browning in food.

Marketing experts only predict that more restaurants and food companies will follow suit in order to keep up with the market and competition. While health food experts are optimistic for this recent trend, as this may encourage Americans to live a healthier lifestyle, other experts in different fields are not so excited. According to numerous lawsuits, many food companies have been accused of only using “All Natural” food labels, without actually using natural food products or not completely expelling GMO or artificial ingredients.

Overview of False “All Natural Label” Marketing Allegations

The craze of all natural food has caused numerous companies to make false claims regarding the ingredients of their products to ensure a sale. Many customers have found themselves an unknowing victim of false advertising and deceptive marketing practices, often angry and disgruntled from paying a higher price for a product they did not even want.

Food products that are either labeled “Organic” or “All Natural” are often marked up at a higher price than products with synthetic ingredients due to an assumed expensive manufacturing process. Overall, a consumer would have no reason to assume that the products with “All Natural Food” labels, are not actually organic and pay a higher price for an undesired product.

According to the FDA, in order for a food product to qualify for the term “natural” it must not include any artificial or synthetic ingredients. This includes all color additives regardless of the source, and any other ingredients that has been added to the product, which would normally not be found in food. Obviously some companies have been found to not be in compliance with the FDA’s definition of natural, which has spurred several customers to seek legal action.

Legal experts are now advising food companies to follow the FDA’s policy and to be honest with their food labeling. Otherwise, it may result in a potential “All Natural Food” lawsuit.
