Fluidmaster toiled connector defect leak damageFluidmaster Inc.’s “No-Burst” toilet connectors are the subject of a class action lawsuit alleging that defects in the product’s design cause substantial water damage and leaks.

Homeowners who have suffered from the water damage and leaks face thousands of dollars in repair costs, the Fluidmaster toilet connector lawsuit contends.

A toilet connector connects the shut-off valve to the tank of the toilet through a flexible hose. It supplies the toilet tank with water.

According to the Fluidmaster toilet connector lawsuit, however, a plastic nut attaches the toilet connector to the toilet tank.

This nut tends to fail, the plaintiff contends. The alleged failure leads to water damage and leaks, as reported by consumers who have lodged warranty claims with Fluidmaster.

This damage happens despite the alleged 10-year warranty promised by Fluidmaster Inc.

According to Fluidmaster Inc.’s website, moreover, the company speaks highly of its own product and characterize it as “the #1 toilet repair brand in the world.

Fluidmaster service parts, according to the company’s website, “are found in more toilets than all other brands combined.” And they contend that “as a customer’s first choice and preferred supplier of toilet tank trim, Fluidmaster has been ingeniously engineering the internal flushing mechanisms of toilets for more than half a century.”

The nut on the No-Burst toilet connector is made of acetal, a thermoplastic produced by the polymerization of an aldehyde and carbonyl function. The material is marketed to be one of the strongest of thermoplastics.

They are also characterized by having a high resistance to solvents and chemicals, having strong electrical properties, and of having strong fatigue life. Additionally, they are often in competition with nylons for the same functions.

Consumers have claimed, however, that the nut that is composed of acetal is not capable to withstand the force exerted on the nut during normal installation and use.

According to the Fluidmaster toilet connector lawsuit, the company has received “thousands of claims for property damage relate to these failures and is the subject of multiple lawsuits around the country over the alleged defects in its No-Burst toilet connector.”

The plaintiff further alleges, moreover, that the defendant knew as early as late 2000 about these issues, including the water damages and leaks, but took no steps to alert consumers .

In 2003, the plaintiff alleges, the defendant knew of an alternative design that could help stop the purported leaks and water damages.

But according to the Fluidmaster toilet connector lawsuit, however, “Fluidmaster simply concealed its knowledge of the defect while continuing to market the allegedly defective No-Burst toilet connector to consumers.”

The plaintiffs also allege that Fluidmaster eventually replaced the old nut with a new model that does not cause water damages or leaks.

The company still, however, is being faced with allegations that it failed to disclose to consumers who had purchased the previous model that a new and revised version was available.
