A new class action lawsuit alleges Flock’s license plate readers are being misused by police officers to track individuals for personal reasons.
Plaintiff Jarrod Whitson’s class action lawsuit argues Flock is responsible for the alleged misuse since it controls the platform that allows officers to access and share the vehicle tracking data collected by the license plate readers.
“Flock’s system therefore does more than identify vehicles: it creates and maintains a searchable record of where vehicles have been and when they were there,” the Flock class action lawsuit says.
According to the vehicle tracking lawsuit, Georgia audited its own Flock usage in 2026, leading to five Albany Police Department officers being arrested for repeatedly using Flock data that had “nothing to do with police work.”
In another abuse of Flock data, a Braselton former police chief was accused of querying the plates of an ex-girlfriend and her teenage daughter roughly 600 times, while “a former deputy is alleged to have put one woman’s plate through the system 1,639 times over several months,” the complaint says.
Whitson claims Flock is guilty of negligence, invasion of privacy by intrusion upon seclusion, negligent design, failure to warn and intentional infliction of emotional distress, among other things.
Flock license plate readers have a high error rate, class action claims
Whitson argues Flock’s system has a high vehicle tracking error rate, with the company admitting that its cameras accurately capture only about 93% of license plates.
The plaintiff claims that, with Flock processing more than 20 billion license plate readings each month, this error rate results in approximately 1.4 billion inaccurate readings monthly.
“Plaintiff and the members of the class did nothing to warrant law enforcement attention,” the Flock class action lawsuit says. “They drove to work, to school, to medical appointments and to places of worship, and Flock recorded them doing it.”
Whitson wants to represent a nationwide class of individuals whose vehicles were photographed and whose license plates were read, recorded and retained by a Flock license plate reader in the United States.
He demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and punitive damages for himself and all class members.
Meanwhile, two separate class action lawsuits accuse Google of using Nest security cameras and doorbells to store and use facial recognition data from people who never consented to having their faces scanned.
