An out of court settlement has been reached in a lawsuit regarding a fatal truck accident which killed a man and his four year old daughter.
Following the death of her husband and child, plaintiff Alyssa C. had filed a wrongful death suit against several defendants, claiming that their negligence caused the fatal truck accident.
According to court documents, a judge has dismissed claims against a driver and her employer in a fatal truck accident lawsuit because the case was settled out of court. No further details were given in the court document.
In August 2015, Ryan C. and his four year old daughter Evelynn were driving on Interstate 15 when they were the victims of a fatal truck accident. A truck driver’s doghouse had fallen off his truck, causing a traffic line-up. Ryan, who was stopped for the doghouse incident, was stopped behind a semitruck when he was allegedly hit from behind by a Canyon Home Care nurse. The impact pushed Ryan and Evelynn’s car into the back of the semi, killing them both.
At the time of the crash, multiple citations were given. The nurse driver received two citations for misdemeanor speeding and following too close, and later paid a $300 fine in court. The truck driver whose doghouse caused the traffic jam was cited for failing to secure his loose cargo and later paid $310 in fines.
The fatal truck accident prompted Ryan’s wife, Alyssa, and his parents to file a wrongful death lawsuit against the nurse, Canyon Home Care, and the truck driver who caused the traffic jam. Their fatal truck accident lawsuit was filed in April 2016.
Following the fatal truck accident, the Utah Highway Patrol investigated the incident. They found that Uchenna, the nurse who crashed into Ryan’s vehicle, made no attempt to stop her vehicle before crashing. Due to findings that Uchenna had no criminal intent, she only received the citations given at the time of the accident.
Despite the findings of the Utah Highway Patrol and the Weber County Attorney’s Office, Alyssa and Ryan’s parents proceeding with their fatal truck accident lawsuit, claiming that Uchenna and her employer, Canyon Home Care, were liable for the accident. Canyon Home Care, an at-home nursing company based in Salt Lake City, argued that they were not liable for Uchenna’s actions because she was driving home from her work day.
Since the fatal truck accident lawsuit was settled out of court, the claims have been dismissed. Although the details of the settlement are not known, an insurance settlement sum has ensured some amount of compensation for Kaya C., Alyssa and Ryan’s other daughter. Uchenna’s insurance company, Mid Century Insurance, awarded $300,000 following the accident. Of that sum, $33,333 has been set aside for Kaya. It will be held in a trust until she turns 18.
