ArFanDuel shares the personal information of visitors to its website with TikTok without their consent, a new class action lawsuit alleges.
Plaintiff Rebeka Rodriguez claims FanDuel aids TikTok’s parent company ByteDance “to surveil its interactions with visitors to its website, allowing TikTok to create detailed portraits of website visitors’ interests, needs and desires.”
Rodriguez further alleges that FanDuel makes false promises to protect visitors’ privacy but then secretly monetizes their personal information by enabling TikTok to spy on them.
“Rather than candidly disclose this arrangement, Defendant explicitly and implicitly assured Website visitors that their identities and privacy would be protected,” the FanDuel class action says.
Rodriguez wants to represent a California class of consumers whose personal information was shared with TikTok or other third parties by FanDuel without their effective and informed prior consent.
FanDuel website uses TikTok tracking software without consent, class action says
Rodriguez argues FanDuel’s website uses TikTok software to spy on users, gathering device and browser information, geographic information, referral tracking and URL tracking by running code or “scripts” on the website to send user details to TikTok.
“The TikTok Software begins to collect information the moment a user lands on the Website before any pop-up or cookie banner advises users of the invasion or seeks their consent,” the FanDuel class action lawsuit says.
Rodriguez claims FanDuel violated California’s Trap and Trace Law. She demands a jury trial and requests injunctive relief and an award of statutory damages for herself and all class members.
FanDuel previously made headlines in 2023 when an unauthorized party obtained customer names and email addresses during a data breach involving the email marketing company MailChimp.

I have caught FanDuel cheating me lying to me with false advertising on the referral of a friend they refused to give me and my friend what they offered by saying he used FanDuel Sportsbook and casino to make his deposit so he didn’t qualify for the bonus money I was supposed to receive but he did not use Sportsbook and casino app because I downloaded the app for him and made sure it was just FanDuel casino I also have screenshots of different glitches that they ripped me off with and I was told I was lying but had screenshots to prove them wrong so they suspended my account for a few weeks because I proved them wrong until the time period was up then my account was unlocked I also have screenshots and proof of other ways they cheated me I was a frequent gambler I have over 583,000$ worth of bets with them who knows how much I was cheated out of before I realized what was going on
