Lyft NewYork Toll OverchargeA class action lawsuit has been filed in New York federal court against the Metropolitan Transportation Authority and other entities, alleging that consumers are facing exorbitant penalties from tolls.

Plaintiff Jason Farina of Westchester County, N.Y., filed the MTA class action lawsuit on behalf of himself and others who have been charged $100 fees from using New York’s cashless toll systems: EZ Pass and Tolls-By-Mail.

According to the New York toll fees class action lawsuit, all MTA bridges and tunnels switched to cashless toll collecting in 2017. Because of this change, drivers are no longer able to pay cash as toll booths have been dismantled. Instead, tolls are charged using EZ Pass or Tolls-By-Mail.

The EZ Pass tag is a transponder which communicates with the system’s antenna to record information and process a charge for the toll, which is charged to the vehicle owner’s EZ Pass account. If a vehicle is not linked to an EZ Pass account, the Tolls-By-Mail system collects the toll by taking a picture of the vehicle and its license plate, which is used to identify the vehicle owner. A bill for the toll is subsequently mailed to the vehicle owner.

The cashless toll system was meant to eliminate traffic congestion in toll booth lines and allow MTA to shift its employees from collecting tolls into roles focused on the safety and security of motorists.

“However, Defendants — who operate those systems and collect tolls from drivers — have used the cashless toll system to line their own pockets at the expense of drivers, primarily by collecting improper fees and penalties in addition to collecting the tolls,” the MTA toll fee class action lawsuit says.

Farina claims that the penalties faced by drivers who do not pay the toll are often substantially higher than the actual toll and may result in drivers being charged more than $100 to cross a bridge or tunnel. Even worse, the defendants impose these fines without giving prior notice to the drivers and wait weeks before notifying them about the penalties. In the meantime, drivers may unknowingly rack up more charges.

“Defendants also aggressively pursue collection efforts against motorists, threatening them with adverse credit reports, suspension of the driver’s license, revocation of their vehicle registration, and seizure of their tax refunds if they do not immediately pay the fees,” Farina alleges in the MTA toll fee class action lawsuit.

Farina claims that he has been charged more than $6,000 from October 2017 to January 2018 by using his EZ Pass on New York’s bridges and tunnels. He claims he never had any significant problems with his EZ Pass tags or account before experiencing these penalties.

Farina says the defendants’ equipment routinely fails to recognize EZ Pass even when a driver has a fully-funded EZ Pass account. He notes that EZ Pass readings can fail for a variety of reasons, such as window tinting, the position of the vehicle, or a dead EZ Pass battery. EZ Pass users are unable to know when the defendants’ equipment fails to read the EZ Pass.

The MTA class action lawsuit says the toll fees are unconstitutional.

    I just left the e-z pass office. I was able to pay my portion of the tolls owed. (yes, i am guilty of that offense paid as requested) I absolutely refuse to pay $9600.00 in violations. I was instructed to call the collection agency and inform them the fees have been paid and i need to have the violations waived. The person that took the call informed me that e-z pass had absolutely no discretion over anything they do. Then tells me to offer them and amount she can submit it and they will get back to me in a few weeks, I offered 10% and was then told no that is too low. I asked for a supervisor who basically told me they would accept nothing less than $2490.00 and that would have to be paid within 30 days. I am so ready to fight this. I cannot afford to pay this so now what? They are making money hand over foot while the little people get shit as usual

    EZ pass is charging me $2000 in administrative fees, the moron from the collection agency actually had the nerve to say why can’t you just pay it, it’s just tolls. What ez pass is doing is criminal.

    EZ pass has charged me $800.00 in administration fees. I do not know if my EZ pass was not read, my online account indicates that I have “no violations”, I never received any violation notices until I was contacted by Transworld to inform me of my outstanding debt through a relative – how embarrassing!!!! I paid my tolls however; EZ pass nor Transworld would reduce the fee to something reasonable. $100 per violation is taking advantage of the public.

    Today is April 22,2019
    Their website is down and I needed to replenish my balance before heading to work.
    I called and spoke to a customer service rep and she instructed me to place my ez pass into the foil sleeve and simply let the toll by mail be sent.
    This will cost me an extra needless fee…I wonder how much EXTRA income is being generated due to this online issue. It makes no sense that I have an ez pass and cannot pay for it over the phone if their website is down, being forced to pay full toll.

    They are trying to charge me $4078 in tolls from July 2018 – August 2018.
    No notice was sent.This is ridiculous! They should not be able to charge people this ridiculous amount of money. I’m from out of state and will like to know how I can this taken to court. That’s money that go towards my kids college.
    Help is very much needed for this.

    They stole 159 dollars from me already. Hundreds of legal and collection threats…. Please let me join the class action suit against this unethical toll for profit in New York State!
