Were you charged exorbitant fees for an unpaid toll violation? If so, you may be eligible to participate in this free class action lawsuit investigation into the practices of EZPass, SunPass and FasTrack electronic toll collection systems.
Gone are the day when the driver threw a handful of change into a basket on a toll road. Today’s major cities provide toll road users with the option to purchase an account from an electronic toll collection system that provides the driver with a transponder attached to the car’s windshield. As the vehicle travels through the toll area, the transponder sends a signal to a database where information is recorded and a fee is charged for the toll.
Many drivers have indicated they were assessed improper fees by the automated system. Drivers who don’t realize there are any issues with their accounts find out weeks later of an alleged unpaid toll violation that has racked up big penalties, sometimes in the thousands of dollars. Most drivers understand if there is insufficient money in their account that they will be assessed a fee, but no one expects to pay thousands of dollars as a penalty for a $10 unpaid toll violation.
Drivers Seek Justice for Unpaid Toll Violation Fees
Consumers have begun taking legal steps to combat the toll penalties they feel are outrageous. They claim these automatic, electronic systems allegedly are designed to make the toll companies and local transportation departments wealthy by overcharging consumers who feel they have no recourse but to pay the bills.
In one case, a Florida resident spent a day in jail because of an unpaid toll violation. She didn’t know she owed any money at all until her license was suspended over the ordeal. Even though she believes a family member might have removed her name from the account without telling her, she still thought she would have received some type of notification to let her know unpaid toll violation penalties were accumulating.
As the world becomes more automated, it appears we have less to worry about. Still, electronic automation is no less fallible than the humans who design it. At the same time, a certain level of trust must be placed in the businesses that design the automation and assign the fee structure. Drivers feel betrayed when penalties are equal to ten times the amount of the initial toll fee.
Drivers who have used New York’s EZPass and Tolls-By-Mail allege they have received $100 penalties to go through a tunnel or over a bridge where a toll fee of less than $100 is posted. Penalties accumulate before the driver receives an unpaid toll violation notice weeks later.
Drivers show trust in these electronic toll collections systems by allowing the companies to hold their funds in advance of incurring toll charges. The businesses should be held accountable when they violate that trust by charging an exorbitant penalty for an unpaid toll violation.

I had to pay a huge fee with my rental car agreement after I returned home from a vacation in FL. I received a bill in the mail. We did go through 2 toll roads but were charged over $40 for a $2 toll.
I just paid what I owed and have not heard back from them. Should I assume that since they cashed my checks that I’m done with them?
