Settlement Achieved in Recent Cervical Cancer Misdiagnosis LawsuitA cervical cancer misdiagnosis lawsuit recently concluded with a settlement for a mother of two. In Europe, a 43-year-old woman who has two children developed terminal cervical cancer.

She launched a high court cancer misdiagnosis lawsuit after she alleged that her pap smear test used seven years ago to detect cervical cancer showed no abnormalities. That test result was later shown to be inaccurate. Ultimately, that case led to a major settlement on behalf of the woman who says that her life might have been saved with advance notice of her disease.

The counsel for the victim in the cancer misdiagnosis lawsuit says that if the smear test had revealed accurate results, she would have been able to get a simple procedure to address the issue and that there would have been a 90 percent chance that she would have been cured of the cancer.

But as things turned out, her expected lifespan after being diagnosed was just under a year, a situation which the mother alleges could have been completely avoided had she received accurate results for her pap smear test.

Although the patient is currently taking another medication, her prognosis does not look positive. The victim claims that her 2011 pap smear test showed the result of no abnormalities, but that this was ultimately incorrect.

The smear test result was conducted in May of 2011 and the reports were forwarded to the woman in June 2011, stating that there were no abnormalities. In June 2014 however, when she received another pap smear test, it identified a high-grade lesion, and she was ultimately referred to a consultant.

She began radical chemotherapy just one month later after she was diagnosed with cervical cancer. A review of her 2011 pap smear sample identified that there was evidence of suspected cancer cells but that the results were improperly forwarded to the patient.

The inaccurate evaluation of the 2011 smear sample ultimately led to the cancer misdiagnosis lawsuit. The result of that cancer misdiagnosis lawsuit is that the woman received 2.5 million euros in her high court action.

A growing number of patients have come forward after learning that they were inappropriately given the all clear following a pap smear. These common tests are used to identify early signs of cervical cancer, and a woman may forego getting another test for several years after receiving good results from the first one.

Women rely on pap smears as a screening device to tell whether or not they need follow-up treatments for cervical cancer. If a mishandled pap smear fails to reveal signs of potential cancer, a minor medical situation can develop into an aggressive case of cervical cancer, endangering a woman’s life.

An audit of the results was only presented to the patient three years after it occurred. The patient was told that without palliative chemotherapy, she would have just around six months to live and with chemotherapy, she would have around 12 months to live.
