GM class action lawsuitGeneral Motors has been the subject of massive recalls in the past for auto defects.

In fact, not too long ago, GM settled the second largest auto defect lawsuit in history regarding recalled parts.

However, GM just announced it is recalling 4.3 million vehicles for a software defect affecting their airbags.

Fortune reports that the GM frontal airbag recall is attempting to address the problem that a software defect can, in some cases, prevent airbags from deploying during a crash.

This issue has been linked with three injuries and one death.

GM Frontal Airbag Recall Puts GM in Hot Water Again

The GM frontal airbag recall affects newer trucks, cars and SUVs from the 2014-2017 model years.

General Motors stated that the sensing and diagnostic module that controls the deployment of airbags has a software defect.

This defect may counteract the ability of the frontal airbags to deploy in certain “rare circumstances when a crash is preceded by a specific event impacting vehicle dynamics,” GM said.

Earlier this year, anticipating the possible GM frontal airbag recall, the company said it could lose $550 million if the recall went through.

This recall deals specifically with the Takata-made airbag inflators. Takata is one of the world’s largest suppliers of auto safety equipment.

Since 2008, Takata has had problems with its airbags and have most recently been linked to fatalities.

A spokesman for GM said, “We consider the vehicles safe to drive.” General Motors did not give information on where or when the airbag-linked crashes occurred, or what specific vehicles were involved.

Because of some reports regarding airbags not fully deploying, GM opened an investigation in June 2016 to look at these incidents.

GM conducted its own testing and re-flashed software was added to all vehicles manufactured after August 24, 2016.

How Do I Know if I am Affected?

Consumers may be wondering if their General Motors car has safe and effective airbags. The vehicles affected by the GM frontal airbag recall include certain:

  • 2014-2016 model year Buick LaCrosse and Chevrolet SS and Spark EV
  • 2014-2017 model year Chevrolet Corvette, Trax, Caprice PPV and Silverado 1500; Buick Encore; and GMC Sierra 1500
  • 2015-2017 model year Chevrolet Tahoe, Suburban and Silverado HD; GMC Yukon, Yukon XL and Sierra HD; and Cadillac Escalade and Escalade ESV

If you own one or more of the GM vehicles listed in the GM frontal airbag recall, you may be able file legal action. Potential claimants should contact a specialized lawyer to determine their eligibility for a GM auto defect lawsuit.

In general, GM recall lawsuits are filed individually by each plaintiff and are not class actions.
