Delta Drugs agreed to a $300,000 settlement to resolve claims it recorded phone calls with California residents without consent.

The settlement benefits California residents who placed phone calls to Delta Drugs between Jan. 1, 2020, and May 25, 2022, that were recorded.

Delta Drugs is a pharmacy that provides prescription medications and a wide range of other services to consumers in California and surrounding states. Delta Drugs customers can enjoy benefits such as complimentary home delivery, direct billing, language translators, and more.

However, Delta Drugs customers may have had their phone calls with the pharmacy recorded without their consent, according to a 2020 class action lawsuit.

The plaintiff in the case says he received multiple calls from Delta Drugs in June and July 2020. 

Before that, he claims, he had numerous phone calls with the pharmacy for filling prescriptions and answering other questions. However, during his June and July 2020 conversations, the company allegedly recorded the phone calls.

According to the plaintiff, there was no way to know his phone calls were being recorded until after the call, when he was advised that his phone calls were recorded. After this, the plaintiff allegedly told Delta Drugs he did not consent to being recorded and “promptly” hung up.

The call recording class action lawsuit notes that the conversations between Delta Drugs and the plaintiff were confidential and discussed sensitive, private medical information. Based on this, the plaintiff allegedly had a “reasonable expectation” the conversations would remain private. However, this was not the case, the class action lawsuit contends. 

The company hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $300,000 class action settlement deal.

Under the terms of the settlement, class members can receive a cash payment. 

Payments will be a proportional share of the net settlement fund, estimated to be $130,000. No payment estimates are available as payment amounts will depend on the exact net settlement fund and the number of participating class members.

If any funds are unclaimed after payment distribution, the remaining money will be divided equally between Public Justice and the Electronic Privacy Information Center.

The deadline for exclusion and objection is Sept. 22, 2022. 

The final approval hearing for the settlement is scheduled for Oct. 25, 2022.

In order to receive a payment from the settlement, class members must submit a valid claim form by Sept. 22, 2022.
