Purchasers of NuWave countertop ovens have recently been complaining that NuWave open parts are not working as advertised, and are breaking after only a few uses. The NuWave oven parts in question are the plastic dome covers, which are allegedly prone to breaking. Consumers say the company has reportedly failed to replace the products free of charge.
These complaints have spurred a class action investigation, with customers complaining that their NuWave oven parts are defective and prone to premature device failure. It has been alleged that the NuWave oven parts in question were mishandled by the manufacturing company, which caused problems in their quality and durability.
The company at the center of this investigation is NuWave LLC, which manufactures a line of countertop ovens that are supposed to be convenient alternatives to traditional ovens. According to the company’s website, NuWave countertop ovens work with conduction heat, convection heat, and infrared heat to prepare food.
The products consumers have been complaining about are the NuWave Oven Pro and NuWave Oven Pro Plus, each of which comes with a NuWave Oven Dome. Purchasers say these oven domes are marketed as durable and resistant to shattering or cracks, but this has allegedly not been the case for many consumers.
These consumers alleged that they were forced to replace their defective NuWave oven parts if they wanted to continue using the product. In addition to the allegedly defective NuWave oven parts, consumers say the company has required them to pay extra money to replace the standard oven domes with more expensive “Power Domes”, which may also be prone to cracking.
Consumers are allegedly tricked into doing this by being told that the oven domes are out of stock, or that they must pay excessive shipping fees in order to receive the oven dome replacement.
These actions have already spurred a class action lawsuit, alleging that NuWave had knowingly sold their customers defective products that were meant to fail and forced customers into buying expensive products and spend more money on their products in general.
Overview of Class Action Allegations
This claim was filed by plaintiff Elizabeth Aguilera, who states that the plastic dome oven parts had cracked in just after a year. Aguilera points out that hundreds of online complaints, which shows other consumers had similar experiences with NuWave oven parts.
“Instead of providing consumers with free, non-defective replacements for their cracked and unusable Standard Domes, NuWave has a standard practice of manipulating consumers into paying to upgrade to NuWave’s newer, more expensive, Power Dome, an amber-colored dome which is advertised as being ‘virtually indestructible,’” the NuWave Oven class action lawsuit states.
Consumers who may be eligible to participate in the investigation include those who purchased a NuWave Oven Pro or NuWave Oven Pro Plus and experienced device complications in the last three years.
These customers may have experienced the plastic covers breaking after only one or a few uses, and were discouraged from using the company’s warranty policy in any way including being told one of the following:
- Being told there were no replacements available
- Being told they would have to pay extra for a “Power Dome” replacement
- Being told they would have to pay expensive shipping and handling fees to receive the replacement
The NuWave Oven Class Action Lawsuit is Elizabeth Aguilera v. NuWave LLC, Case No. 1:18-cv-03550, in the U.S. District Court for the Northern District of Illinois.
