
A new mesothelioma lawsuit has been filed by a North Carolina husband and wife, alleging that the husband was diagnosed with mesothelioma as a direct result of exposure to asbestos products during his work as a mechanic.
The plaintiff, James W., was diagnosed with mesothelioma on Nov. 19, 2017. James alleges the mesothelioma was caused by his exposure to asbestos during the decades he worked as a mechanic.
According to the complaint, a number of companies were responsible for his exposure. The mesothelioma lawsuit named companies including Air & Liquid Systems, Carrier, General Electric, Viking Pump, and a slew of others as defendants. According to the lawsuit, these companies manufactured or distributed products containing asbestos that led to the plaintiff’s exposure to the dangerous material.
James and his wife Sharon filed the mesothelioma lawsuiton Feb. 9, 2018, in the U.S. District Court for the Middle District of North Carolina. The mesothelioma lawsuit asserts multiple claims including defective design, failure to warn, breach of implied warranty, and gross negligence.
What is Asbestos?
Asbestos is a naturally-occurring mineral and was widely used for commercial purposes such as electrical products or building insulation, as well as countless other uses.
Over time, however, exposure to asbestos containing products was connected with serious risks, including the development of mesothelioma cancer. As these risks have become better known, more and more asbestos regulations have been put in place to protect workers and the general public from the toxic mineral. Because of these regulations, since the 1970s and 1980s, the use of asbestos-containing products has diminished greatly. The Environmental Protection Agency (EPA) banned new uses of asbestos in 1989.
Asbestos-related illnesses can take a long time to surface, so many workers who were exposed to asbestos decades ago are only now being diagnosed with mesothelioma and other complications of exposure. This can mean there are fewer treatment options.
When a person suffers from exposure to asbestos, microscopic fibers can accumulate in a person’s lungs. The fibers can attack the lining of the lungs, then spread even further to other organs. Exposure to asbestos can lead to serious medical issues, including mesothelioma cancer.
