A consumer has started a credit union overdraft fee lawsuit alleging that financial institutions are charging illegal fees.
Plaintiff Jamie L. has initiated a class action credit union overdraft fee lawsuit based on the allegations that Apple Federal Credit Union has violated the law.
The credit union overdraft fee lawsuit accuses the credit union in question of using illegal overdraft fee practices. Jamie t alleges that Apple Federal Credit Union assessed overdraft fees to deposit accounts that were not truly overdrawn. She also claims the credit union assessed overdraft fees because of non-recurring debit card transactions without obtaining informed consent from account holders.
The credit union overdraft fee lawsuit says that beyond being unconscionable and unfair, these actions breach the contractual promises that Apple Federal Credit Union made to all of their account holders. Jamie says the credit union claimed they would only charge overdraft fees as a result of transactions that would truly overdraw an account and would not charge overdraft fee for one-time debit card transactions without the account holder’s informed affirmative and written consent.
According to the overdraft fees class action lawsuit, however, Apple Federal Credit Union was regularly engaged in charging overdraft fees for consumer deposit accounts even when those accounts were not overdrawn and is also accused of assessing overdraft fees for debit card transactions in which the account holder had never given their express consent to do so.
Grounds for a Credit Union Overdraft Fee Lawsuit
Credit union and bank class actions have become more popular in recent years following claims from consumers about illegal behaviors. If a credit union or bank unfairly charges overdraft fees in an effort to expand their profits while also harming the rights of the consumer, affected members may have a legal claim.
Apple Federal Credit Union is one of the six biggest credit unions in Virginia. The plaintiff who initiated the Credit Union overdraft fee lawsuit says that the proposed Class Members could include numerous individuals throughout the area and many may not have realized that the credit union overdrew their accounts.
Apple Federal Credit Union allegedly charges overdraft fees of $29 each for many transactions from a debit card that could lead to the overdraft of a personal checking account.
According to Jamie’s credit union overdraft fee lawsuit, however, the contractual paperwork associated with consumer relationships with the bank say that in the event of multiple debits made against an account that did not have appropriate funds, the account owner was responsible for replacing the missing funds and paying a fee assessed by the bank.
Many consumers have come forward in recent years to argue that credit unions and banks have been involved in illegal and unfair practices that were deceptive for consumers.
