Dollar Tree class action lawsuit overview:

  • Who: A former Dollar Tree employee filed a class action lawsuit against Dollar Tree Stores Inc. and Dollar Tree Inc.
  • Why: The plaintiff claims Dollar Tree failed to pay hourly workers for off-the-clock work, overtime and missed meal and rest breaks.
  • Where: The Dollar Tree class action lawsuit was filed in Colorado state court.

A new class action lawsuit alleges Dollar Tree failed to pay hourly workers in Colorado for all the time they worked, including off-the-clock hours, overtime and missed meal and rest breaks.

The plaintiff, a former employee at a Dollar Tree location in Weld County, claims Dollar Tree did not properly pay her and her co-workers for time worked beyond 40 hours in a workweek, 12 hours in a day or 12 consecutive hours, counting both on- and off-the-clock work.

Under Colorado law, non-exempt employees who cross any of those thresholds must be paid one and a half times their regular rate of pay, the class action lawsuit explains. The plaintiff argues that hours worked off the clock never made it into workersโ€™ pay, so overtime they earned went unpaid.

โ€œThe plaintiff and class members regularly worked off-the-clock for [the] defendantsโ€™ benefit and were not properly compensated for all hours worked,โ€ the Dollar Tree class action lawsuit says.

The former employee claims the alleged wage theft was willful, alleging Dollar Tree knew it had a duty to pay workers and had the financial ability to do so.

She wants to represent a class of all current and former hourly-paid or non-exempt employees who worked for Dollar Tree in Colorado from three years before the complaint was filed through final judgment.

Dollar Tree workers allegedly missed paid rest breaks

The former employee claims workers regularly had meal periods that were late, shortened, missed, interrupted or taken on duty or on the premises. She says rest periods were likewise late, shortened, missed or interrupted, and workers were not properly paid for that time.

Colorado law requires a paid, uninterrupted 10-minute rest period for every four hours worked. When a required rest break is not provided, the workerโ€™s shift is effectively extended by 10 minutes without pay, according to the class action lawsuit.

She further alleges Dollar Tree required employees to cover job-related expenses and costs without reimbursement, reducing their pay below the legally required wage rate and adding to the alleged wage theft.

The lawsuit claims Dollar Tree violated the Colorado Constitution and state minimum wage, wage payment and overtime laws. The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of unpaid wages, liquidated damages, penalties, interest, attorneysโ€™ fees and costs for herself and all class members.

Meanwhile, Dollar Tree is facing a class action lawsuit in North Carolina, claiming the company violated federal law by printing too many credit card digits on receipts.
