Simply Orange PFAS class action lawsuit overview:ย 

  • Who: A New York man has filed a revised class action lawsuit against Coca-Cola and its subsidiary Simply Orange Juice Co.ย 
  • Why: The plaintiff says the company sells juices that contain PFAS, otherwise known as forever chemicals.ย

A month after a manโ€™s class action lawsuit against Coca-Cola and its subsidiary, Simply Orange Juice Co., was dismissed, heโ€™s filed a revised version โ€” this time alleging heโ€™s tested multiple juices made by the brands and found harmful chemicals in all of them.ย 

New York resident Joseph Lurenz filed the amended complaint on July 9 in a New York federal court, alleging violations of state and federal consumer laws.ย 

Lurenz claims that Simply juices contain significant levels of per- and polyfluoroalkyl (PFAS) compounds, based on independent testing.ย 

PFAS are also known as โ€œforever chemicalsโ€ because they are resistant to breaking down. They are artificially produced chemicals used to enhance everyday products like stain resistant clothing and furniture, cosmetics, and food packaging material.

However, PFAS can also have an impact on human health that scientists are just starting to understand, Lurenz says.ย 

โ€œScientists are studyingโ€”and are extremely concerned aboutโ€”how PFAS affect human health,โ€ he says. โ€œConsequently, the (Centers for Disease Control) outlined โ€˜a host of health effects associated with PFAS exposure, including cancer, liver damage, decreased fertility, and increased risk of asthma and thyroid disease.โ€™โ€ย 

Plaintiff files amended complaint, with new research

Lurenz claims that the juices are deceptively marketed as pure, healthy and all natural, due to the presence of PFAS.

His original complaint was dismissed by Judge Nelson Roman last month, who said Lurenzโ€™s claims were based on test results that were not adequately connected to his own purchases of Simply Orange products. The judge ruled that the plaintiffโ€™s claim relied on only a single allegation of testing that found PFAS in the juice and โ€œcites no studies or articles indicating that the product generally contains PFAS.โ€ย 

Since then, Lurenz says he has obtained independent third-party testing that found โ€œwidespread and uniform contaminationโ€ of Simply Orange products, with levels of perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS) in Simply Tropical more than 100 times higher than lifetime health advisory levels the U.S. Environmental Protection Agency deemed safe for drinking water.ย 

He says he tested a range of Simply Orange products that he bought, including pulp-free versions of Simply Orange and Simply Orange with Mango. He says the products contained significant levels of PFAS.ย 

โ€œThus, there is no possibility that the PFAS contamination is limited to a single unit or a single product line โ€“ it is now more than plausible that the entirety of defendantsโ€™ product line is contaminated and that this issue is systemic,โ€ he alleges.ย 

Simply Orange PFAS false advertising claims

Despite this, the company continues to market Simply Orange as โ€œnaturalโ€ and give the impression it is safe and healthy through the use of terms like โ€œpure filtered waterโ€ and โ€œall-natural ingredients,โ€ he says.ย 

He is looking to represent anyone who bought a Simply juice in the United States.ย 

He is suing for violations of the New York Deceptive Trade Practices Act and New York State Agriculture and Markets Law, as well as negligence and unjust enrichment, and is seeking certification of the class action, damages, fees, costs and a jury trial.ย
