GM ignition switch recall class action lawsuitAs the number of General Motors ignition switch recall class action lawsuits steadily increases, two plaintiffs who have filed a similar action are seeking an injunction that would force the automaker to tell owners of several models to take the vehicles off the road completely. The judge handling the case will hold a hearing April 4.

Charles and Grace Silvas have sought an injunction known as a “Park It Now” alert, noting that the ignition switch defect that can lead to airbag failure affects more than 1 million owners, “placing [owners] at the mercy of defective vehicles that may, at any moment [emphasis original], lose power steering, power brakes, and fail to deploy airbags in the likely event of a crash.” The Silvas are plaintiffs in a proposed class action lawsuit related to the GM ignition switch recall.

The request for an injunction regarding the General Motors ignition switch recall also notes that the failures “are purportedly triggered by something as simple as a key chain on the vehicle’s key or a bump in the road” and in fact the ignition switch recall notice indicates that “rough road conditions” and other factors could still lead to an airbag failure or related issues.

GM disputes that it must issue the “Park It Now” notice. A hearing has been scheduled for April 4 for the parties to argue about the merits of the proposed injunction.

A similar class action lawsuit currently pending in Michigan federal court argues that the automaker should also pay for any necessary repairs and inform current owners or lessees, if there are any of the latter, of what parts they will be using and how General Motors will remediate the issue. The lead plaintiff is acting on behalf those parties in relation to all of the vehicles affected by the current General Motors ignition switch recall.

The General Motors Ignition Recall Class Action Lawsuits are Charles Silvas and Grace Silvas v. General Motors LLC, Case No. 14-cv-00089, in the U.S. District Court for the Southern District of Texas, and Adnan Jawad, et al. v. General Motors LLC, Case No. 14-cv-11151, in the U.S. District Court for the Eastern District of Michigan.

According to a Youtube video released by General Motors CEO Mary Barra, the parts that will reportedly fix the problem will begin showing up at dealerships by April 7, but it will take until the fall, “no later than October,” before enough are produced for all of the vehicles affected. That statement came before the company issued a separate recall on March 29 that affected a further 490,000 trucks and 170,000 compact cars for unrelated issues.
