General Motors, already facing a mountain of plaintiffs who have, or are likely to, file GM ignition switch lawsuits, can expect to see that number to grow with the addition of the popular Chevrolet Camaro to the list of at least eight other vehicles whose keys can become dislodged and cause the shutdown of electrical systems.
Unlike some of the other models that have been recalled, these are more recent models, including more than 450,000 Camaros built between 2010 and 2014. More than a dozen incidents had been reported, including at least several few motorists who were able to dislodge the keys simply by bumping them against their knees. The ramification of the millions of vehicles potentially losing power and causing crashes in which airbags cannot deploy are massive.
Those who own the vehicles, particularly those who were involved in accidents, can consider either filing an individual filing an ignition switch lawsuit or be part of a group filing a GM ignition switch recall class action lawsuit. Among the allegations would be defective design, negligence, and misrepresentation based on reports that General Motors knew of these issues more than a decade ago and did nothing to fix the problems. Even before the Camaro recall, replacement parts will not be available to all vehicle owners until the fall.
The automaker’s potential liability could extend beyond personal injury. At least one woman has already filed a lawsuit as a result of the GM ignition switch recall, alleging that a crime she was arrested for involving her vehicle only occurred because of the defect. For anyone else who may now wonder what had happened in an incident involving their cars, the damage could be extraordinary.
There is one other major issue: While both the 2.5 million vehicle recall and this latest one involving late-model Chevrolet Camaro sports cars focus on the keys, they are reportedly caused by separate issues. The potential exists, then, that the GM ignition switch recall and subsequent GM ignition switch lawsuits could split into two prongs.
