Verizon wireless sign An Arkansas couple claim they fell victim to Verizon’s “bait and switch” scheme in a two for one iPhone deal.

According to plaintiffs George Wise and Barbara Gilbert-Wise, this deal was “purposefully deceptive, false, unconscionable, fraudulent, and also allowed Verizon to be unjustly enriched.”

The plaintiffs claim that, in May 2019, Mr. Wise went into their local Verizon store seeking to take advantage of Mother’s Day promotions.

Specifically, he aimed to take advantage of the deal which reportedly allowed consumers to “Buy iPhone XR, iPhone XS MAX, iPhone XS, or iPhone X and get a free iPhone XR (or take $750 off a second iPhone X model)” when “adding a new line on Verizon Unlimited.”

While at the store, a Verizon employee allegedly told Mr. Wise that he would be able to participate in the promotion. Mr. Wise says he was told he would receive a second iPhone free of charge if he added an additional line to his account and purchased another iPhone, promises which were “all consistent with Verizon’s Mother’s Day Promotion.”

Based on these representations, Mr. Wise reportedly chose to participate in the bargain by adding a phone to his account and purchasing a new iPhone as a gift for his wife Mrs. Gilbert-Wise. He expected he would receive an additional iPhone free of charge, which could be used by his son on his recently added phone line.

However, Mr. Wise says he was deceived into authorizing installment payments for the supposedly “free” iPhone. He was reportedly charged for the phone in June 2018 on their first bill following the transaction.

“Mr. Wise purchased the new iPhone for his wife and added a new line to his Verizon account based upon the false, misleading, deceptive, and unconscionable advertising, and further, has had to pay for the additional iPhone that was falsely promoted as ‘free,’” the Verizon class action lawsuit claims.

“As a result of the false, misleading, deceptive, and unconscionable advertising identified in this pleading above, Plaintiffs and the Class have commonly suffered actual financial losses from the addition of the cellular phone lines and resulting charges, and the payments and continuing payments for the two new iPhones — one of which was falsely promised to be free.”

According to the Verizon class action, Mr. Wise attempted multiple times to resolve the issue. However, Verizon has allegedly refused to issue a credit for the “free” iPhone, “thus, its false, misleading, unconscionable, unjust, and fraudulent charges for the ‘free’ iPhone and additional line remain.”

The plaintiffs seek to represent a Class of Arkansas consumers who purchased an iPhone XR, iPhone XS MAX, iPhone XS, or iPhone X from Verizon and added an additional line to their Verizon account between May 1, 2019 and May 31, 2019 based on promises that they would receive a free iPhone XR added to the new line.

    I don’t even know where to start, but yes, this has happened to me with Verizon. I was on the insurance with Verizon with my iPhone 13 Pro Max and I’m paying insurance for it and whenever the back glass broke, I could get that fixed within you know 30 minutes I never had to pay anything well this last two times I had to pay $100 each and I Shion tells me that because Apple no longer makes the iPhone 13 that I had to pay out of pocket $99 each time when the insurance was clearly still stating that it was unlimited times that I could get this repaired so you know I was going back-and-forth with Asurion going back to Verizon Asurion was telling me that Verizon should’ve informed the customers of this Verizon is telling me that no I didn’t have to p so I don’t know what’s going on with that but also when I’m going on with Verizon, is they you know they got me to get out of my grandfather account and upgrade my phone with the upgrade you know they promised me a free iPad as long as I know opened up a new line which I went ahead and I did so they were supposed to send me a phone the Google pixel tenfold they were supposed to send me the earbuds the Google pixel watch and the free iPad. I never got nothing. I was still charged for the IP, I’m sorry for the phone the earbuds and the watch. I was calling them and calling them and calling them that I never received the items that FedEx or whoever delivered it you know verify that they were not able to deliver it. There was times that I was spending eight hours on chat with these representatives man you know every time I spoke to them they were gonna supposedly fix the issue but no they had to escalate. They were throwing $40 here $50 here of credit I got up to about $400 in credits and having $400 in credits. My bill was not being paid. I was still disconnected. I was still getting late fees. I was still having to pay reactivation fees when I brought this to assure I’m sorry Verizon’s attention they just pretty much laughed in my face executive relations didn’t help me for not. They’re pretty much saying that I’m wrong when I have that I have the caller ID that I spoke to a supervisor because she cleared my bill. She completely cleared my bill and the next day the bill was back. How does that even how does that even right? Tells me that she’s gonna go ahead and take care of my $300 bill she tells me to refresh I go and refresh and sure enough next day it’s back there. She never followed up like she said she was Verizon owes me so much money. They were still charging me for the phone. The watch the earbuds months after not receiving it and they’re trying to call me crazy they’re trying to say that I’m wrong and at the end of the day they got what they wanted. I got out of my grandfather account and they were able to take all my you know, per and so as this happened to anybody, I believe I have a lawsuit
