British Airways & Virgin Atlantic Class Action Settlement

Virgin AtlanticA proposed settlement has been reached in a class action lawsuit against British Airways and Virgin Atlantic Airways over fuel surcharges. If you bought a ticket on either one of these airlines between August 11, 2004 and March 23, 2006, you may be entitled to a partial refund of the fuel surcharge.

 

The British Airways and Virgin Atlantic class action lawsuit settlement will resolve claims that BA and Virgin Atlantic unlawfully conspired to fix prices of fuel surcharges imposed on long-haul passenger fares. As a result of this alleged fuel surcharge conspiracy, passengers suffered harm by having to pay more for flight tickets.

 

British Airways and Virgin Atlantic deny the price-fixing conspiracy charges but have agreed to establish a $59 million class action settlement fund to refund U.S. class members, and a fund of over £73 million to refund U.K. class members.

 

To be considered a class member of the British Airways and Virgin Atlantic fuel surcharge class action lawsuit settlement, you must have purchased a ticket for either airline between August 11, 2004 and March 23, 2006 for a qualifying long-haul flight and were charged a long-haul fuel surcharge that was not refunded. “Long-haul” flights include most flights between the U.K. and non-E.U. destinations, including flights to and from the United States. All flights on Virgin Atlantic qualify as long-haul, and therefore qualify for refunds under the Virgin Atlantic class action settlement. As part of the passenger fuel surcharge settlement, U.S. class members who file a valid claim before the deadline of December 31, 2012 will be paid 33.3% of the passenger fuel surcharge they paid on qualifying coupons. Refund payments under the class action settlement will range between $7 and $34 per passenger per round-trip ticket purchased in the U.S.
