A new class action lawsuit accuses the Boston Red Sox of falsely advertising prices for Fenway Park tickets to baseball games and other events at Fenway Park by using “drip pricing” and hidden fees.
Plaintiffs Damon Campagna, Lily Rose Smith and Patrick Spaulding claim the Red Sox would advertise “illusorily low prices” for Fenway Park tickets, only to add mandatory hidden fees — such as “Per-Ticket Fees” and “Order Fees” — at the last minute.
The plaintiffs argue the mandatory hidden fees could increase the cost of a ticket purchase by as much as 150%.
“In other words, the Red Sox’s advertised tickets were not actually available for purchase at the advertised prices,” the Boston Red Sox class action says.
Campagna, Smith and Spaulding want to represent a nationwide class of consumers who purchased Fenway Park tickets from the Red Sox between Jan. 16, 2022, and the present and, in connection with such purchases, paid additional hidden fees that the Red Sox did not include within their initial price advertisements.
Red Sox hidden fees ‘unfair and deceptive,’ Fenway Park class action says
The plaintiffs argue the Red Sox’s use of drip pricing and hidden fees was “unfair and deceptive” and illegal under the consumer protection laws of Massachusetts, and other states, alleging the use of drip pricing and junk fees misled ticket buyers and caused them to pay more than they intended.
“Plaintiffs bring this action on behalf of a class of ticket buyers to seek redress for the Red Sox’s violations of Mass. Gen. Laws ch. 93A and other state consumer protection laws,” the Boston Red Sox class action lawsuit says.
The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of actual and treble damages for themselves and all class members.
Another baseball team, the San Francisco Giants, is also facing class action allegations it charged hidden junk fees for tickets to the Major League Baseball team’s home games.
