A Georgia woman filed a class action lawsuit against BMW alleging the automaker failed to disclose a defect in several of its vehicle models that poses a significant fire risk. 

Plaintiff Sedera Huff filed the class action complaint against BMW of North America LLC Dec. 18 in a New Jersey federal court, alleging negligence and violations of consumer laws.

The lawsuit centers on a defect in the electrical connector on the water pump, which allegedly allows water to collect, causing a short circuit in some BMW vehicles, the lawsuit says.

Huff, who owns a 2016 BMW 528i, claims the company neglected its duty to ensure the safety and functionality of its vehicles and failed to inform customers of the defect despite initiating a recall of more than 720,000 cars in August 2024.

Huff says the alleged defect increases the likelihood of a fire. 

The affected vehicles include several BMW models manufactured between 2012 and 2018, such as the BMW X1, Z4 and 3 Series, among others, according to the class action lawsuit.

BMW didn’t warn customer of defect, recall, according to class action

Huff, who has only ever serviced her car at a BMW dealership, says the automaker never informed her about the defect or recall despite consistent maintenance visits. 

“Plaintiff was never informed that water could reach the plug connector, causing an electrical shortage, which could increase the risk of a thermal event and cause a fire,” the lawsuit alleges.

BMW’s August recall offered a free replacement of the water pump and plug connector, along with the installation of a protective shield to prevent further issues. However, Huff alleges the automaker failed to meet its obligations to its customers. 

“When a vehicle manufacturer provides a warranty, it must stand by that warranty,” the lawsuit states, adding that BMW’s actions have caused inconvenience and safety concerns for affected vehicle owners.

Huff is looking to represent all similarly affected owners or lessees of the recalled vehicles. She is suing BMW for failing to adequately inform consumers about the defect and for allegedly neglecting its duty to ensure the safety of its vehicles. She seeks certification of the class action, damages, fees, costs and a jury trial.

In October, a South Carolina woman filed a separate class action lawsuit against BMW over the same issue.

    I did not receive the recall letter and was stranded in Orlando when the water pump failed. I had just come off of a seven hour flight and the car immediately overheated upon starting it. I had to get a hotel room $110, and pay for the $2,100 repair. I ended up having to rent a car to get home – 90 minute drive – while my husband waited at the mechanic for 9 hours. It was a horrible experience that could have been avoided. PLUS – the car had been to the dealership twice since last August, where they could have taken measures or notified me.

    I used to own the 328xi 2007 it was smoking from the engine. They had a recall but the fix wasn’t out before I dumped it.

    I agree with this lawsuit 10000000%
    I use to own a 3 series and a 5 series I had so many problems with it that I ended up selling them and purchased a Mercedes! I will NEVER purchase a BMW ever again! BMW stands for BURN MY WALLET! Don’t let the luxury look fool you! BMW also has oil leak problems and warranty is never honored! Owning a BMW was very stressful! Do Not purchase one!
