Bank of America

Over 185,000 current and former Bank of America employees are eligible to claim money from a $73 million class action settlement approved by a Kansas federal judge in December 2013. If you worked at a BofA banking center or call center after 2005, you may be eligible to participate in the Bank of America wage settlement and claim a minimum of $20 or more.

The Bank of America wage class action settlement resolves multiple class action lawsuits accusing the company of denying certain wages to non-exempt (hourly) employees working at Bank of America retail banking centers and in certain positions in certain Bank of America call centers. The cases were consolidated in 2010 as In re: Bank of America Wage and Hour Employment Litigation in Kansas federal court.

The consolidated complaint contends that Bank of America violated various state and federal wage and hour laws, including failing to pay straight-time and overtime compensation, failing to provide meal and rest breaks, forcing employees to work off the clock, forfeiting vacation pay upon termination, and more.

The company denies the allegations but agreed to pay a $73 million class action settlement to resolve the Bank of America wage and hour litigation.

Who’s Eligible

Class Members of the Bank of America wage and hour settlement include all individuals who worked for the bank in:

  • a banking center in California on or after Feb. 13, 2005;
  • certain call centers in California on or after Feb. 13, 2005;
  • a banking center anywhere in the United States on or after Oct. 19, 2006 (September 15, 2005 for individuals who worked in the state of Washington); or
  • certain positions in certain call centers throughout the country on or after Oct. 19, 2006.
Potential Award

$20 Minimum. Additional compensation will be awarded based on a point system approved by the Court. A Class Member’s points will be calculated by multiplying his or her most recent hourly base compensation rate by the number of weeks worked in the relevant time period with certain adjustments designed to fairly account for the relative value of certain Class Members’ claims.

    Checks for most claims should be out by late Sept or early Oct . More definite date with next week.

    Called settlement admin. Checks are being processed and should be out by 9/1 to 9/15 to comply with settlement orders. Some areas will have to wait longer. Read settlement agreement online.

      call 1-877-366-1145 the will tell you when your check was mailed and where. it takes up to 2 weeks to receive. i moved and they sent me another check and stopped the one that was sent to the old address. you speak to a live representative.

            I sent in my form in early June and never got a check either. The hotline says checks were mailed in September and you can’t talk to a person.
