T.J. Maxx recalled products settlement overview: 

  • Who: T.J. Maxx has agreed to pay a $13 million fine to the U.S. Consumer Product Safety Commission. 
  • Why: The fine is being made to resolve claims TJX Companies — the parent company of T.J. Maxx, along with HomeGoods and Marshalls — continued to sell products after they had been recalled. 
  • Where: T.J. Maxx has locations in 45 states across the United States. 

T.J. Maxx has agreed to pay a $13 million fine to the U.S. Consumer Product Safety Commission (CPSC) in order to resolve claims it continued to sell products — including the Fisher-Price Rock ‘n Play Sleeper — after they had been recalled. 

The Fisher-Price Rock n’ Play Sleeper has been linked to 30 cases of infant deaths since 2009, NBC News reported. In total, T.J. Maxx was accused of selling at least 1,205 units of 21 recalled products from between March 2014 and October 2019, according to Law360. 

The number of infant deaths caused by the Fisher-Price Rock ‘n Play Sleeper may actually be even steeper than first believed, with a congressional report determining last year that 50 infants died as a result of using the product prior to it being recalled in 2019. 

The congressional report accused T.J. Maxx of continuing to sell the Fisher-Price Rock ‘n Play Sleeper for a decade — while earning a total of $200 million in revenue from sales — despite allegedly knowing the dangers it presented to infants. 

T.J. Maxx accused of continuing to sell a variety of recalled items

T.J. Maxx also was alleged to have continued selling the Kids II brand Rocking Sleeper — which was recalled in 2019 after being linked to being behind at least five infant deaths, NBC News reported. 

In addition to the recalled sleepers, T.J. Maxx also allegedly continued to sell recalled items including furniture, coffee presses, knives, certain kitchen appliances, and barstools and chairs, among other things, Law360 reported. 

TJX Companies — the parent company of T.J. Maxx, HomeGoods and Marshalls — has also reportedly agreed to create a compliance program and implement systems that will ensure it is in compliance with recalls going forward. 

A class action lawsuit was filed against Mattel and Fisher Price in 2019 after the Fisher-Price Rock ‘n Play Sleeper was recalled from the market. 

A separate class action lawsuit was filed against T.J. Maxx last year by shoppers claiming the department store shared their data with third-party software firms without first getting permission.
