Gerber Baby Food Non-GMO Class Action Lawsuit Overview:

Gerber Products Company falsely advertises its baby food products as “Non-GMO,” a new class action lawsuit alleges.
Plaintiff Faith Norman claims Gerber is “cheating” consumers by mislabeling baby food products that do in fact contain genetically modified organisms.
Norman wants to represent a nationwide Class and California subclass of consumers who have purchased Gerber baby food mislabeled as “Non-GMO.”
Norman claims Gerber’s baby food is “loaded” with ingredients that come from genetically modified crops like corn and soy, as well as protein and dairy from cows that have been fed GMOs.
Gerber also has a number of artificial ingredients that were “genetically engineered in a laboratory,” the class action lawsuit alleges.
Norman says she relied on Gerber’s representations that its baby food was “Non-GMO” when she decided to purchase its Good Start 2 baby formula on multiple occasions.
Had Norman known the claims on Gerber’s labeling, packaging and marketing materials was “false and misleading,” however, she says she would not have purchased the product.
“These representations were part of the basis of the bargain in that she would not have purchased the Products, or would not have purchased them on the same terms, if the true facts had been known,” the class action lawsuit states.
Gerber Intentionally Mislabels Baby Food To Make It More Desirable, Plaintiff Claims
Norman claims Gerber intentionally mislabels its baby food products as “Non-GMO” in order to make them appear more desirable for a growing number of health-conscious consumers.
“The market for all natural foods has grown rapidly in recent years, and Defendant seeks to take advantage of this trend through false advertising,” the class action lawsuit states.
Norman argues consumers want to avoid food products containing GMOs for a variety of reasons, including personal health and environmental concerns.
“Many consumers, including Plaintiff, try to buy products that are not derived from GMOs, and a movement has developed demanding consumer products that are non-GMO products,” the class action lawsuit states.
Norman claims Gerber is guilty of unjust enrichment and fraud, among other things, as well as in violation of California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act.
Plaintiff is demanding a jury trial and requesting relief in the form of compensatory, statutory, and punitive damages for herself and all class members.
A separate class action lawsuit was filed against Gerber in October over claims the company sells baby food containing dangerously high levels of toxic heavy metals.

My son is currently 14 months and that is all I would give him was Gerber foods from cereal, formula , baby food ect and I just really hope his system is not messed up because I’ve been struggling to get him to really eat well since he was 3 months
