AT&T data throttlingA California man claims AT&T is running a phone refund program that cheats customers out of the refunds they’re properly entitled to.

Plaintiff Simon Meron claims that AT&T’s handling of its own return and refund process for mobile phones is so ineffective and poorly implemented that it violates several consumer protection laws.

He alleges the company fails to follow the terms of its own mail-in return program, keeping refund money that it should have sent to its customers within a specified number of days.

According to Meron, AT&T offers a return policy for new phones that lets the customer return the phone for a full refund within 14 days of purchase.

Customers may ship the phone to AT&T with a request for a refund, and within 14 days of receiving the phone AT&T is supposed to send the customer a full refund, Meron says.

But in practice, AT&T creates a thicket of false promises and customer service runarounds that prevents customers from ever receiving this refund, Meron alleges. He says the company never intended to honor its promise of a refund. Rather, AT&T tricks customers into purchasing a new phone and maintaining their AT&T plan, he claims.

Meron claims he bought a phone from AT&T in October 2015. He says he sent it back to AT&T for a refund within 14 days of his purchase and expected to receive his refund 14 days after that, in accordance with the company’s refund terms.

At the same time, Meron alleges that AT&T refused to cancel his service contract. So he had to purchase a new phone in order to keep using his AT&T service, he claims.

Fourteen days later, Meron says, he still had not received his refund. The plaintiff claims he called customer service and was told the refund was on its way, but several days later it had still not arrived.

Meron says he ultimately made 16 phone calls to AT&T customer service, trying to track down his refund. He claims he was frequently reassured that he would receive his refund, though in other phone calls he was either put on a long hold or the call was dropped.

To date, Meron says, he has not received the refund that AT&T has promised him several times.

Meron filed the AT&T class action lawsuit in California state court in May 2016. Defendant AT&T has since removed the case to federal court.

If certified by the court, Meron’s proposed Class will represent all persons who bought a phone from AT&T and shipped it to AT&T for a refund but whose refund was not processed within 14 days of the date AT&T received the phone.

The AT&T class action lawsuit seeks an award of damages, and restitution of all money gained via the alleged unlawful business practices, plus costs of the suit and attorneys’ fees.

    I can not stand ATT !!! I have a 2 phone line and internet with them. They have you on yearly contract at different dates for local, long distance, and internet. when you have a business that requires all three to be in working order at same time, its impossible to change providers. I get a 3 different notice (for each one) that my contract will expire and I must call to renew or deal with the consequences of higher non-discounted rate. Every time I call, I am on hold for a long time until some crappy ass customer sales rep trying to upsale me to add this and that to my plan. Its a freakin nightmare each time. Also, ATT called and advised me that new fiber optic router needs to be installed due to the changing demand in my area. I made sure over and over that they will be no charge for technician to come in to install this new router. Well, 1 month later, I got a bill for $109( 100 for the router and tax). I must of called and was on hold numerous and countless times. Finally someone from retention dept called and deducted from my usual inflated bill. This process took 8 months long !!! Lastly, I got a postcard saying if we call this number, we get a starbucks gift card. I did not believe it but wanted to test them. Well, call was made and no sight of starbucks card !!!

    I also had account here in Texas. That say they applied refund to account. When I call and ask they say I owe 500.

    I got internet service with ATT and it was only for a day, They dont have service on this area well they dont send me my refund until a month laterand on top of that they bill me 200 dollars for a service I dont have and send me to collection, I call ATT and recorded all out conversation and I told them I am recording you they say its fine and they say they fixed the problem and I dont have to pay anything, lie, couple months later a collection agency call and say I own 200 dollars to ATT , call ATT back and they say no problem we gonna call you back, I still waiting for the call back and now I am on collection for a service that I dont have.

    I was also promised a refund for a phone I returned and never received the refund but instead ended up with a $1500.00 bill. To date, they still are continuing to bill me. ATT is the worst. I am also recommending a class action suit be filed against them for their illegal cable services. Every month my bill is between $250 and $400. I could owe a Mercedes for the amount of money we pay to them each month. I definitely need to be included in the lawsuit!

      I would like to comment on the cable service. I was paying like 300 or more for cable when 50 percent of the channels have no interest to me. and what about all the different taxes on each service? I am being charged $10 for HD service and my television is an HD television. why does it cost so much to watch nothing interesting on television?

    I had two lines with AT&T and every month I was getting hundreds of minutes of overage fees. Several years later we find out AT&T charges 1 minute even if your on the phone 4 seconds! I know it might be difficult to charge on the second BUT it should be a little more fair. Maybe like on the 10 seconds? They rib everyone off

    All cell phone companies are crooks and take your money. I have fought with AT&T and Verizon so many times on these issues that I have lost count!

    Sounds like typical AT&T crap too me. Its the type of things they pulled on me back in the 90s and 2000s and why I will never use their services again. I would love to see them go bankrupt though except they take advantage of too many big company tricks to do that. Did the last class action against them net a whole $5 per person but the people were overcharged $5 a month for over a year on average? Maybe this time the lawyers will actually work on behalf of the cleinetele and not AT&T?

      Jimbo – I so totally agree. I also will never use their services – They owe me $248. for services billed but not provided… Instead of paying me, they make up charges and send thru collection agency… I sent proof of payment every time but they kept sending it to other collection agencies. When they finally accepted that it had been paid, after sending proof via certified mail, they made up another charge and sent it to collections and to my credit report. They are too big and I also wish they would be cut down big time!!
