  • Judge David C. Godbey consolidated claims against AT&T in February 2022, less than a month after plaintiff Jill Witte filed a lawsuit.  
  • The judge consolidated Witte’s lawsuit with that of Steven Palumbo; Palumbo filed his complaint in August 2021 and later amended it in March 2022. AT&T and co-defendant DirecTV responded to the complaint later that same month. 
  • AT&T and DirecTV then filed a motion to compel arbitration for the consolidated class action lawsuit in April 2022.
  • Judge Godbey dismissed the case without prejudice in March 2023.

AT&T misleads new customers by promising them reward cards that it either never mails or sends near or after they are set to expire, a new class action lawsuit alleges.

Plaintiff Jill Witte claims AT&T uses the promise of a reward card, often worth between $100 to $400 and that expires after 150 days, to tempt new customers into signing up. 

Witte claims AT&T either never sends the cards or “delays” doing so so that it won’t have to honor them. 

“Rather than sending the card to new customers immediately after they contract and pay for their new AT&T services, AT&T either never sends the Reward Card or delays sending it such that new customer recipients don’t receive it until near or after the card’s short 150-day expiry period,” the class action lawsuit states. 

Further, Witte alleges AT&T may also attempt to offer customers a lesser value card than they were originally promised.

Witte claims AT&T’s offer of a $150 reward card persuaded her into signing a contract with the company last year to receive bundled television and internet services. 

While alleging she was told the reward card would arrive in the mail within six to eight weeks, Witte claims it never came during that time and that an AT&T representative eventually told her she was not eligible to receive it. 

Witte claims AT&T ultimately agreed to send her a $50 reward card instead, which she says she did ultimately receive. 

Monetary value of reward cards reduced by AT&T restrictions

Once activated, AT&T also places restrictions on the usage of the reward card, such as by freezing the card for an extended period of time if a threshold amount is spent. 

“AT&T’s processes, limitations and restrictions on the Reward Cards and, therefore, their adverse impact that reduces the actual monetary value of the Reward Card to the prospective new customer, are not adequately disclosed at the time new customers are induced to enter into their contracts for bundled services with AT&T,” the class action lawsuit states. 

Witte claims AT&T is guilty of negligent misrepresentation and unjust enrichment and in violation of Florida’s Unfair and Deceptive Trade Practices Act

Witte wants to represent a nationwide class and Florida subclass of AT&T customers who either never received their reward card, received it after it had already expired or were unable to activate it. 

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with compensatory, special, treble and general damages for herself and all class members. 

A similar class action lawsuit was filed against AT&T last year by a consumer in Florida who argued the company either never sent or sent nearly expired reward cards to new customers who switched to the provider.

    I too was promised a rewards card worth $200.00 when I moved my account from one carrier to AT&T. I was told that I would receive an email letting me know when to expect my rewards card, this was in April of 2023, it is mow July of 2023 and no card. I contacted AT&T and was told that I am being given $200.00 in credits on my bill worth $5.32 (+/-) over a 36 month period. When I asked an AT&T store manager about this I was told the same as at the original store where I signed up. I don’t want a discount spread out over 36 months, I want my $200.00 gift card! AT&T has been nothing but a pain to deal with and I really regret having ever signed up with them.

    I have a screenshot from the day I ordered clearly showing the $300 promo applied, another promo (separate) for paying switch/early termination fees, and what level of internet I was ordering (500 mbps) and the date. I screenshot things like because of trust issues. Good thing I did BUT so far it is not getting me anywhere. I signed up as a current wireless customer and was offered a $300 reward card, the switch/ETF offer, and a NVDIA game code. I got a $100 reward card. I contact them about it and they say wait for another 30 days. Well, when I log into my ATT account it says my $300 reward card expires in 24 days. I told them this and that if I wait 30 days I do not believe they would honor it. My account says $300 and so does my damn receipt. Yet call after call and nothing is done. I have clear proof of what was offered and they’re still giving me the run around. It’s obviously a scam to get people to join. Some are unfortunate and get no reward, or it’s mailed late or lost. I can’t believe they’ve gotten away with this so long. It’s deceptive and I would think illegal.

    I was offered $300 on 5/31/2023 and was only given $150. Have been on the phone with AT&T for almost 2 hours. They are only giving me $150. I have everything written down whom I spoke with and time of day from the initial new customer set up. I told them this is illegal and they still only offered me the $150 in rewards. Is there something that can be done for this unlawful action?

    Yo todavía sigo esperando la tarjeta de $300.00 que me dijeron que me iban a mandar al sol de hoy nada, y aparte de eso cuando agarre línea de teléfono, que solo iva a pagar $ 165. Por la activación de los teléfonos, después chequeo mi estado de cuenta del banco y me hicieron tres pagos más, me vino mi primer bill de 131.65 pero ya el segundo me vino de $365, hemos llamado pero no nos solucionan nada, solo nos pasan de departamento a departamento, losvendedores no explican las cosas bien, ellos por hacer su venta y ganar dinero no explican y lo peor es que nos podemos salir de esa compañía.

    I signed up for AT&T internet, six months later got offered a 300.00 reward card if I switched phone carriers and participated in the bring your own phone/phone number. Almost 3 years later, I’m still an AT&T Internet and cell phone customer, but I’ve never received my gift card nor any type of credit towards my bill. After complaining and arguing I gave up wasn’t worth my time or words. Never referred any family or friend to AT&T and I won’t.

    Was promised $300 reward card. They issied it with incorrect first and last name in the card and it was received after expiration date! When I called they said it was sent months ago and there was nothing they could do. I would not receive the reward.

    Had exactly this happen to me. I was promised $300 in rewards for new Fiber service and never received a letter or email with information to claim it. I was told since I never claimed it that it expired and they are systemically blocked from reissuing. Scam for sure.

    I received a promo card and the last day before expiration I attempted to use it several times and consistently got an error message. Im pretty sure it was a scam card that wasn’t usable. They duped us for sure and lied about deals, offers and promotions that never happened. I’m trying to switch phone providers now after 8 years and over $20,000 in on time payments
