Aspen Dental Class Action Lawsuit

The Aspen Dental class action lawsuit was dismissed on March 27, 2015.

Aspen Dental, one of the nation’s largest corporate-dental chains, has been hit with a class action lawsuit accusing it of illegally owning and operating dental practices and of deceiving patients with aggressive sales pitches for expensive treatments after they’ve been lured in with promises of free exams and X-rays. Aspen Dental owns and controls 358 clinics across the country and markets to low-income patients that can’t afford dental care.

The Aspen Dental class action lawsuit was filed following a June 2012 report by PBS FRONTLINE and the Center for Public Integrity titled “Dollars and Dentists” that uncovered Aspen Dental’s practice of servicing patients who can’t afford a dentist and then allegedly locking them into debt. Some patients in the report also alleged they were overcharged and given unnecessary treatments.

The Aspen Dental class action lawsuit was filed October 18, 2012 by 11 patients across the country who accuse the company of violating laws in 22 states that require clinics to be owned by dentists actively performing procedures onsite. The laws are designed to prevent business interests from overshadowing those of patients.

Aspen Dental said Friday that the accusations in the class action lawsuit “are entirely without merit,” and that it provides support services to dental offices owned by local dentists.

“The dentists and staff at Aspen Dental offices around the U.S. provide access to high quality, affordable dental care for millions of patients,” the Syracuse-based company said. “Their singular commitment is to do what’s right for their patients.”

However, attorneys for the Plaintiffs say in the class action lawsuit that Aspen Dental trains the dentists and sets production goals for them, and accuse the company of illegally practicing medicine. They are seeking class-action status to cover potentially tens of thousands of current and former patients.

In 2010, Aspen Dental reached a $175,000 settlement with the Pennsylvania Attorney General’s Office over misleading information about discounts, consultations, financing and other promotions.

Plaintiffs in the Aspen Dental Class Action Lawsuit are represented by attorneys Brian Cohen and Jeffrey Norton.

    I would love to file a clam against Aspen Dental, I went in for a cleaning and came out own them over $3600.00. My insurance paid $1200.00 so for the total of 4800.00 I got a good flossing and a tooth brush. But that is not the worst I did not have the money to pay them the $3600.00, So now my credit is bad, because the sent it to collection. I tell everyone to stay away from them.

    I would like to file a lawsuit also i have a top and bottom partial and they hurt terrible and i start feeling sick when i put them in and the stuff they put on my front teeth has chipped. They also said they pulled another tooth that o didn’t see then put me in a room telling me how much to pay now i’m. in a mess paying some bank and i’m on medicare really can’t afford it either

    Help, 6 unit bridge set with temporary cement. this is documented in dental chart. went back to have permanent cement and dentist could not get bridge off. she said its ok to keep temp. cement. now have tooth abscess, 4 teeth have root infections and everything I drink just causes pain. Im in the process of getting the work corrected. currently on very strong antibiotics. will cost thousands more to correct as now I need root canals. this is the least of it, the best possible outcome. don’t want to think about loosing good teeth. Hope you can help. thank you

    Please forward me information as to how to be added to this class action case or to begin another. I had four crowns placed not even 5 years ago and two have broken completely off including the post. In so many words I was told this was a botched job and the two times, including today I have to pay to redo the job as well as additional dental work I’m told is needed. Mind you I was just in the office last month to get two of the four crowns replaced due to a clean break on one and my gun growing under the other. (I was left in the lobby for 6b hours last month after being told the doctors are now at lunch.) I asked one several different occasions what the issue was and I was told I was a add on and had to wait, when the on call doc had told me the Friday prior to arrive that Monday morning first thing and have them notify me that you’re here. A NIGHTMARE and rip off!!!!!!!!!!!!!

    Please tell me how I can join in the class action suit against Aspen Dental.
    I originally went to aspen dental to have a tooth fixed. I received their exam and X-rays and was then told that my teeth would not support a partial plate. That I needed to go with a full upper denture. Of course I listened to the professionals. After receiving my permanent denture I keep telling the dentist that they were to loose. He did some slight adjustment and told me they would be fine. They have never fit correctly. They are always loose and when I tried telling them again they just put me off as though it was not their problem. I have gone back to them also because one of the teeth in the denture snapped off and I was not even eating anything when this happened. They fixed the denture and now here it is about 2-3 months later and the same tooth has snapped off again. I bought the most expensive dentures they sell so I wouldn’t have problems. I don’t think it’s fair for this company to take advantage of people.

    Aspen is a business owned by a Dental Lab. Not a dentist as required by law. They also mark up procedures to draw the maximum fee from the insurance. They routinely write off co pays among other things

    I went also paid almost 5000. For dentures that do not fit I have told them they do not fit but they keeping telling me they supposed to be big and finally they said come in for Soft liners I paid to much to have to have soft liners and they look crooked not happy with them at all
